No one noticed the trailer in the background of the photo of the car? I'm pretty sure this wasn't OP's photo, since he mentioned the buyer posted a pic on facebook. Still, pretty golden and definitely smells like troll doo.

Every time I've sold a car the title transfer was in the presence of a notary. Isn't that necessary in Florida?

I'd say the majority of people buying 800 dollar cars in FL live in trailers. And when I bought a car in FL, the guy just signed the title over to me. No notary needed.

The buyer didn't put him in any situation. The seller put himself in a situation by selling a car. There are responsibilities involved with selling a car beyond 'pay me'.

As a run of thumb, always assume whoever you sell a car to is going to immediately rob a bank and run over multiple bystanders with it and you'll be fine.

He answered the FB message I sent him. This is what he said:

"Im getting it you don't have to worry about it I just need to know where at they towed it too but ill pay for it my phones off right now buti recently foind out today that it got towed I didmt even know but ill get it out"

What should I say?

Idk about other states but in CA, the title of each car has at the top where each of you sign and the previous owner has to mail into the dmv to say yes, this car is sold and now I am not responsible for it.

If you in fact had this, life would be so much easier. Eigher way. Contact the DMV to see what your options are.

Why would you wait to tell him where the car is? If he goes and gets it out earlier then that's great. Now you know it is off your back. Either way, you are still going to the dmv to sign for the transfer thing. You really don't care if he properly get it in his name. You just want to no longer be in your name.

Op screwed up the sale paperwork, but he can fix it.

Save his FB post. Create a bill of sale. Back date it to the date you sold it to him. Sign it. Send him the original. Send a copy to the tow yard with the buyer's address and tell them the date you sold it to him. Tell them to stop collection efforts against you. Send it certified

Did you sign and date the back of the title when you sold it to him? If so, get a copy from the buyer. This will prove the date it was sold.

Since you actually sold it to him before it was impounded you don't owe anything to the tow yard. Lots of bad advice itt.

You should probably read this before doing anything.

Florida Statute Section 713.78 - Statutory Liens for recovering, towing, or storing vehicles and vessels.

Every bill of sale Ive ever created for a vehicle I sold was signed by the buyer.

"Lastly, when it comes to sell the item on the bill of sale, make sure that you have a witness. Let your witness sign the bill of sale after the buyer signs the bill of sale to finalize the sell. Follow the above steps and you will have written up a legal bill of sale that will stand in any court."
