i got pulled over one night leaving a skate park and the cop was one of those "drug recognition experts" (in NC). he searched my car, found nothing, then took me down to the goddamn hospital for a blood test before throwing me in a holding cell all night. they charged me with DUI (for marijuana) and released me, without having found anything on me and without having a result from the drug test back yet. i pled not guilty and my lawyer got it dismissed on the grounds that 1) the protocol for the "expert" detection status was super weak and should be discredited and 2) moving eye tests, which he based his premise of me being high on, are actually inadmissable in court as evidence.

we had to actually go to trial and fight it in court tho

Did the state have to pay for your lawyer? Cause that's ****ing bull****. I would most likely sue for false imprisonment

I agree. It's entertaining to follow the special prosecutor drama, but actual bad things are happening that shouldn't be ignored. Jeff Sessions's approach to charging and sentencing, which is straight out of the 1980s, is a perfect example.

Crap like this is common, especially on the East Coast. I grew up in NJ and moved to FL about 10 years ago. I've made the I-95 trip probably 20x. GA and VA are notorious for having cops hiding at state borders to grab you for speeding. They love pulling people over from out of state b/c they know that person isn't likely to fight a speeding charge. They literally hide in the bushes Dukes of Hazzard style.

For those who assume that all SCOTUS decision break on party lines, it's worth noting yesterday's 5-3 decision in a gerrymandering case. Thomas was the deciding fifth vote and he sided with Kagan and the other "liberal" justices.

These sorts of weird, one-off coalitions are not infrequent, even in cases like this one that obviously have political implications.

That is not true. There is an "act of production doctrine." Basically, courts have found that in some instances, the very act of producing the documents is incriminating in itself, and thus the 5th applies.

A simple example, someone steals documents from my business. I suspect you stole them and send you a subpoena for the document. Producing them would obviously incriminate you, so courts say that this is the equivalent of being forced to give self-incriminating testimony that you stole the documents.

This doctrine is not particularly well defined in practice, so will be interesting to see what documents Flynn would be allowed to withhold under the 5th.
