So Broedelet, Guagenti and Gola took a collective loss of approximately 318,000 from their equity. The Borgata lost the house fee of about 288,000. I would certainly be consulting a lawyer if I were one of them, although I'm not sure what their chances are of winning. Probably not very good.

First they've got to convince the court system that they have a case despite the Borgata following DGE's ruling, and despite the ruling not implicating Borgata for any negligence. Next, they've got to explain ICM and poker tournament equity models to a judge (possibly a jury, I'm not sure whether the plaintiff or defendant chooses in a civil case), which is going to be difficult in and of itself.

I'm curious, a few in the Final 27 have posted that Lupo or others at the Borgata told you guys not to worry, they'd make it right. Have you heard anything from those people since?

The fact that Lupo is giving quotes to the Press of AC that they gave out the 288K in the house fee because it was the right thing, and that they weren't forced (even though the ruling says they were), probably doesn't speak well to his likelihood of even addressing what was said before.

If I was in charge of a rival casino in the AC area I'd offer up the chance for the remaining 27 to finish the tourney at my poker room... Let them each start with their published remaining chips, make the prize pool be $900k and proportion it to what the published % of prize pool was for each of 1st to 27th, offer to comp the 27 a flight and room, and watch the amazing PR roll in... Would for sure become a national story and the PR of it would more than be made back for whichever casino had the guts to do a move.

Because Lusardi was the "chip leader", he set the"mark" for anyone wanting to become the chip leader for the day. Lusardi received a $2000.00 bonus for this accomplishment. He was clearly the chip leader for group 1b and 1c. People in group C had Lusardi to chase down to receive the $2000.00 bonus. Lusardi set the "mark".

1. Now here is an argument for GROUP 1c. Since I played in group C, I looked at the leader board and saw Lusardi as the chip leader. . I believe he had somewhere around 325k. Now, that number was a "FRAUDULENT NUMBER" and what it did was this. It deceived me and other players in group 1c. I was shooting for an unrealistic number in the tournament and it changed my style of play.

2. Since Lusardi was the chip leader from day 1b and 1c he was given a $2000.00 bonus for this. Anyone that played in flight 1b and 1c should automatically receive a refund. The number he set as chip leader was a "fraudulent number". The Borgata rewarded him with a $2000.00 bonus for his false number.

1b and 1c should get refunds.
Its amazing the lengths people will goto to try and justify getting free stuff.

"We take game integrity very seriously at our casino--so much that we are willing to right the wrongs of one of our rivals so that people are not dissuaded from the entire industry. We felt what happened at borgata and how the victims were treated was something that could damage the reputation of the entire industry, including us, if we did not show just how much we value making our customers good when there is a failure to protect them."

^^
In reference to the idea for another casino to offer the 27 a shot at the 900k borgata robbed them of .........

Would be brilliant for a casino in PA or NY to do this. Stick that final dagger in AC. This ruling just shows how ridiculous the state of NJ is. They have been fighting casino expansion to north jersey and such for so long that they would rather die(surrounding states taking away business) than just figure out a fair solution to keep people in their state gambling in NJ.

For me to accept no negligence from Borgata, I would like to know:
1) When and how often fake chips were introduced.
2) When did players first complain to floor about possible fake chips.
3) Is it possible that fake chips were noticed and ignored after days 1b, 1c ended, and no action taken because of Borgata's exposure to cancel tournament.
For people talking about lawsuits, I would think that if you can prove that they were aware of the fake chips long before they had no choice but to stop tournament (after call from Harrahs reporting fake chip discovery) they may have a claim.

I think this is unfortunately likely best outcome Borgata could come up with under the circumstances. I know I'm in minority and it obviously sucks for the top 27.

There may be grounds for a lawsuit though.

So the final 27 had a tougher road to get top 27 than normal right? Unless they were cheating as well

Wasn't there something like 200,000 extra chips after day 1 as listed by chip counts, which is way outside the normal range of color ups. Should have been noticed then.

My god man. Its the truth...Black and white....

What happens if a race car is the high qualifier on speed, but cheated. Then a car chasing that speed crashed in qualifying because the person driving that vehicle was chasing an illegitimate number?

Get the point? You have to press and use different tactics.

I'm surprised at how unfavorable this ruling is to the remaining players, it's basically inviting a lawsuit.

There will be lawyers.

Why would they if you weren't affected?

I guess super butterfly effect would be someone busted by fake chips rebuys in 1c and winds up busting people and he would have not originally played.

I guess I would think the second lusardi entered the tourney everyone from there should get refunds. Just a messy situation.
