This is only claiming accounts at Sun First, which were presumably controlled by Stars/FTP or a processor. It does not make a claim wrt FTP/Stars corporate assets (software etc). Could the DoJ reach a settlement with Stars/FTP in which that account is forfeited to the DoJ and then litigate it out with Robb Evans?

I agree, it would make no sense to include the return of those funds as assets of FTP part of the deal, the government will either strike the claim that those accounts belong to Johnson's creditors and get to keep all of the money, or they won't, but it should not effect the deal.

I see the deal as a swan that's caught in a current and wants to swim to freedom. Even though the lawyers might be trying to show the swan how to get free of the current's pull, the judge might not want the swan to get free. All we can do as outside observers is say 'be strong little swan be strong' and wait with baited breath.

Unless it comes this week..... pessimistic views are lame, obviously its been a year and half but this would have been a better post if you wrote it a month ago+ and not during the week that everyone has high hopes again.
