I don't believe that would be grammatically correct. In any case, you're right if we don't have the money it's not done.

Doesn't "was" just fit the past tense tone of the sentence? At the time he turned himself in new ownership was expected to take over. It still is.

Assuming he's convicted or cops a plea, (or some combination of the two), Ray Bitar will do serious time. How much time depends on several factors, the most important of which would be to what extent he rolls over on CC-1 and CC-2. If Raymond Bitar decides to take the full rap for this and refuses to roll over on Howard and Jesus, Preet Bharara and Arlo Devlin-Brown will seek to make an example out of Bitar - they'll try to convict him on as many of the counts as possible and send Bitar away for 20-25 years. On the other hand, if Mr. Bitar decides to be cooperative agreeing to a plea deal, he'll wind up with a much reduced sentence - something on the order of a 5-year max sentence. Whatever the case, Ray Bitar will be spending a significant part of the rest of his life in a jail cell - he's not going to spend the next 10 years in the Witness Protection Program.

Part of the problem with Howard, Jesus, and Ray Bitar is their attitude and demeanor - the way they consciously chose to give the Government the proverbial finger telling the DoJ, in effect, "Go F yourself! We're not breaking any laws and we're not changing a thing." When you are engaged in a legal gray area and you're conveying that kind of arrogance, you're just asking for trouble ... it's like the matador waving the red flag in front of the bull.

By comparison, Isai Schienberg is a thousand times smarter since he didn't go out of his way to insult the DoJ - he was very careful not to make any of this personal. Isai probably has better legal counsel too, since I doubt if he will ever be extradited to the United States to stand trial.

Not to mention that Isai is a businessman who operated in a grey area, not a thief who routed the player funds to himself, friends, and family.

It does seem that what we have with Full Tilt is a bunch of poker players who were used to grinding for a living and then lucked into a gold mine. Once the money started flowing, greed overtook them. The difference between them and Isai is that Mr. Schienberg didn't let it go to his head.

Anybody with a chin like Ray Bitar's who has a bloatee that they think makes them look skinny shouldn't be trusted, because they tend to be people who are more out of touch with reality than the mean.

This motion to deny bail makes no sense, SDNY couldn't even get a judge to deny bail to Bernie Madoff, and they had a confession to his own son that his business was nothing but lies.

How they could expect Judge Kaplan to deny bail for Bitar, supposedly because the sentence is so severe if convicted, when they are in the same breath recommending 18 months for Beckley when UB was no less of a 'Ponzi scheme' than FTP, alludes me.

What does make sense is them wanting to get Bitar and his lawyer in front of Judge Kaplan, perhaps hoping he will recuse himself from the case.

No one can tell you this with certainty. There will likely be some interesting developments on Monday or maybe before. They may go a long way to resolving the case. Or they could get an extension on Monday. Or the negotiation could break down tomorrow.
