anytime you deal with an Indian tribe, regardless of what the operation is, be prepared for total chaos in the event that you feel the necessity to file legal action against them because the first thing they will do is to claim "sovereign immunity" which basically means "you can't sue us"

this is precisely the tactic various tribes are using to run what are otherwise illegal usurious loan programs around the country. they are hiding behind the internet and making excessively high interest loans (250% range) then illegally repossessing vehicles, etc. to force payment. then you try and sue and run into a brick wall with the sovereign immunity argument

I have lost total respect for Indian tribes for this reason and absolutely refuse to do business with any of them in any state even in their brick and mortar operations

if you ever get arrested/charged with criminal conduct on a reservation, you very well may feel like you are an American citizen fighting for his life in a Mexican prison (and you can't speak Spanish).

way too much freedom has been afforded these "tribes" and now they are abusing it in a big time way

Wow. I just looked at the finpay.net web site. It is light years ahead of where it was back in August. Very professional now. BUT, knowing who is behind it (their sordid history), it makes alarm bells go off.

Their concept is for consumers to load up a virtual wallet with all sorts of personal ID & financial information, including:

SS # (required to open an account)
Driver's license
bank accounts
credit & debit cards
loyalty cards
gift cards
"health card"
other id cards

Then, add funds to your Finpay account and you can use your virtual wallet to transfer money to or withdraw money from, with no fees, any merchants that are members of their network, and earn finpay loyalty points for cash back. You also get a FinPay prepaid card for atm withdrawals (with a fee). You can also withdraw by ACH or bank wire for a fee, or by mailed check for free.

Here's the kicker - the "business" section of their web site claims that they have a network of "650 merchants". What?! They essentially didn't exist in August. What merchants?

I hope players who deposit through Finpay to PrivateTable are very cautious about what info they provide. I highly recommend that you don't use your regular banking info, but get a separate bank account with limited funds just for this purpose.

Maybe there are 650 tribal members?

Sure, they all could have set up Finpay accounts to receive their distributions from the rake/vig profits.

I'm shooting in the dark here -- things don't add up.

They could be piggy-backing on another company, or group of companies network. Similar to how some banks have a network of thousands of ATM's across the country despite only owning a few local ones.

I submitted this question to Finpay support:
Quote:
I ran across your site and am thinking of opening an account, but want to see how useful it will be for me. Do you have a list of merchants which currently accept Finpay payments?
This is their response:
Quote:
Thank you for contacting FinPay.

All registered users have access to our retail merchant network. We do not provide a public list but once registered you will have full access to the network. Our open registration was for a limited time for compliance testing. When we invite new registrants we will keep you in mind.

Thank you for contacting FinPay.
Interestingly, the support ticket was assigned to and answered by Christopher M. Wolfington as the support agent. He is the site owner. Perhaps he is also the one and only staff member.

Just got this to my inquiry as a merchant.

Quote:
Thanks for inquiring about FinPay. We are a private network and therefore only registered users have access to the list of merchants. I can tell you that our merchant network consists of hundreds of shopping, entertainment, and lending brands. We will be allowing open enrollment in the near future which would allow merchants to apply for network membership. In the meantime here is some information on our platform:

The Financial Payment Network is a financial technology company providing a robust mobile payments platform specializing in regulated markets. Our cloud-based platform consists of a digital wallet, pre-paid card, and merchant network connecting consumers with everything they need to shop, bank, and access entertainment venues online. The company’s unique “in-network” payments architecture offers merchants specialized payment solutions and services while lowering the overall costs of payments for both merchants and consumers.
It is the unique combination of our FinPay™ Digital Wallet, our FinPay™ Pre-Paid Card, our multiple access points, and our loyalty program that makes our technology and processes highly valuable to merchants and consumers alike.

The Financial Payment Network™ Platform delivers differentiating value to consumers and it’s merchant partners:
1. FinPay™ Merchant Network
Thousands of retail merchants available to consumers for shopping, gift cards, entertainment, and banking. The FinPay Merchant Network provides shopping discovery, product search, price comparison, daily deals, coupons and gifting - with the ability to make purchases and deliver them anywhere, with a few taps. Members of our merchant network benefit from a low cost payments environment with our “in-network” payments architecture.

2. FinPay™ Digital Wallet
Cloud-based digital mobile wallet platform that provides consumers with an anonymous mobile digital wallet with access to the FinPay Merchant Network for shopping, peer-to-peer payments, bill pay, consumer loans, and entertainment venues.

3. FinPay™ “In-Network” Payments Platform
FinPay’s™ “In-Network” architecture provides a seamless integration between consumers and merchants at the lowest possible cost. Funds between merchants and consumers can be recycled numerous times without having to access costly third party bank, credit, and debit networks.

4. FinPay™ Loyalty Rewards
Consumers earn loyalty points for their everyday shopping, banking, and entertainment experiences that are redeemable for cash back or merchandise available from the thousands of merchants in FinPay’s Merchant Network.

5. FinPay™ reloadable Pre-Paid Card
Consumers demand real-time access to funds while at the same time desiring a level of anonymity. Payment solution using 100% out of network transactions will be too costly to merchants and provide no privacy to the consumer. The Financial Payment Network’s FinPay™ pre-paid card will reduce cost, provide privacy and real-time access to FinPay™ wallet funds, and the flexibility to be used at any ATM or make purchases anywhere major debit cards are accepted. Our FinPay™ Pre-Paid Card removes barriers that otherwise cost merchants millions in lost revenue.

6. FinPay™ Access
Through www.finpay.net and our FinPay™ Mobile Application consumer’s can manage their account, get statements of their transactions, transfer funds, and receive promotions and offers from our merchant network members. Consumers can also earn points through our loyalty programs and use those points to purchase valuable merchandise at thousands of our merchant network partners.

7. Currency Conversion Technology
The Financial Payment Network recognizes the value of offering consumers more options when it comes to payments, and bitcoin is no exception. By accepting bitcoin we are expanding the payment alternatives available to consumers and members of the FinPay™ Merchant Network. Our FinPay™ Digital Wallet accepts bitcoin for deposits & withdraws as part of our payment solution. Though bitcoin has realized expanding adoption by consumers, regulators have been slow to approve this new virtual currency. We convert bitcoin to US currency for consumers prior to any transaction with our merchants so merchants can feel safe & secure that they are compliant with all current regulatory requirements. We also take the currency exchange risk so you don’t have to. Our bitcoin currency conversion feature is a game-changing proposition, especially for Merchants where traditional payment methods are expensive and facing growing restrictions within the bank and credit card communities.

The Financial Payment Network™ Platform
Our Robust compliance centric payments platform leveraging loyalty, mobility, consumer intelligence, and gift & stored value functionality
[IMG][/IMG]
The FinPay™ Platform facilitates cash access and online payments connecting consumers and merchants through proprietary mobile applications and point of sale software. FinPay™ utilizes its digital wallet technology to seamlessly bridge the gap between land-based, mobile, and online merchant environments.
The FinPay™ Digital Wallet allows consumers to facilitate electronic commerce transactions with thousands of retail, entertainment, and banking merchants. This includes facilitating transactions on-line with a computer or using a smartphone to facilitate transactions at the point-of-sale. Many merchants operate in a highly regulated environment. Accordingly, our digital wallet strategy is not limited to basic financial transactions but to also authenticate the consumer's credentials, such as age and geographic location.

I hope this information is helpful.

God Bless America!

I wonder if they have the legal right to use those company logos in their graphic (adidas, fandango, etc.), let alone already have them as members of their "financial payment network".

Santa Ysabel Temporarily Forgoes Real-Money Online Poker for…Bingo?

Quote:
As first reported by Chris Grove via his daily newsletter OPR Quick Take, the Santa Ysabel tribe is putting its real-money online poker plans on temporary hiatus. In the interim, PrivateTable.com will supposedly launch as an Internet bingo parlor.

This, as per sources close to the tribe.
So seems it was just a bluff after all. I call!

TODAY'S TALK

SANTA YSABEL is close to launching PrivateTable for real-money online wagering, according to sources close to the tribe.

But, in an unexpected twist, poker won't be the first game to go live. Instead, it will be bingo that serves as the launch product for SY Interactive, possibly in conjunction with one or more additional tribes.
Too soon to conclude it was just a bluff. All the legal hurdles are identical for bingo as they are for poker. The only difference is the clear distinction that 'electronic aids' are explicitly permissible for bingo.

There is still the issue of where the gaming activity takes place. That is an issue they may indeed have a real problem with https://www.scribd.com/doc/242317114...Internet-Bingo

I think part of their end game was an attempt to force california legislature to quickly pass a legalization bill. The timing of it all made sense for that, anyway.

Nope. Although I imagine they are close. Just as they were close at the beginning of October. And in September. And in August. My best guess - they are just three-fiddy away from going live and will be close sometime in November.
