Yeah, that's the terms you suggested. That the arbitrator only be instructed not to decide no-action, but otherwise be given no instructions. jalfrezi has rejected your suggested terms. Instead he has (a) suggested the arbitrator be given no instructions at all, or alternately (b) the arbitrator be instructed to both not to decide no-action, and to decide the two underlying questions. You have rejected both of jalfrezi's suggested terms.

Now... you could continue this process of negotiation, by trying to convince jalfrezi of the righteousness of your suggestion (which you haven't justified at all so far), or by trying to convince jalfrezi of the unfairness of his two suggestions (all you've done is said "ha ha ha"), or by making a second suggestion (as jalfrezi has done).

Instead, you've decided, it seems, to continue playing the fool, and that you'd rather whine and dissemble than make any further attempt to negotiate any possible arbitration.
