how do you alums deal with friends who failed the bar exam? i passed mine but some of my classmates didn't. one dude, who's a pretty close friend, is pretty open about it. with others we'll both know they failed but it's not out in the open. i just talk about non-law type stuff but it is just awkward.

Completely depends on the person.

I only had two friends who didn't pass the bar. One was more of an acquaintance who was in Pennsylvania (where his family lives) when the results were posted and simply didn't come back. He's apparently doing pretty well in banking now, actually.

Second was/is a good friend of mine who felt pretty confident that he had failed. BarBri provided us all with a chart showing which of the potential essay topics had been tested on each of the last 15 bar exams, or something like that. Secured transactions had been on the test twice, once several years ago, and once on the February 2007 exam (we were taking July 07). He played the odds by not taking a single look at secured transactions materials, and of course there was an entire essay on it (out of nine). Didn't take it again. Probably the best thing that could have happened to him, though. Now he's into real estate (his own rental properties), supplements his income playing live poker 3-4 times a week in rich guy home games, and takes month long vacations.

Got my first law school "A" today -- it was in a business-oriented course (I was business undergrad) that met for the first half of the semester. Being that I'm a 2L without a big firm offer, I feel like I'm the coach of an NFL team that's out of playoff contention but just beat an even worse team 35-0.

I don't know how far you've gotten in the semester, but think of CivPro like a checklist - from the plaintiff's point of view, in order to get the case up and running where you want it, you have to have x, y, and z (e.g. personal jurisdiction, subject matter jurisdiction, service of process, well pled complaint, and so on). From the defendant's point of view, you are looking at the same checklist, but thinking about how you can challenge the plaintiff at every possible turn. The key is to think about essay questions from the point of view of each party - what do they want, and how do the rules enable them to get it/prevent them from getting it (hint: defendants usually want the suit thrown out, or at the very least, to proceed in the jurisdiction/venue of their choosing).

I know it's been discussed a decent amount ITT, but it's worth repeating for any new 1L's (like me) who haven't read through the whole thing:

Microsoft Onenote is the nuts. If you're using something besides specialized note taking software for your in-class note taking (I have a friend that does all his stuff in word) you're missing out, imo. It's definitely worth trying out if you aren't using it already.

Hi guys,

I have another question!

Let's assume that a citizen from Texas commits a murder in Alaska; is the discipline applied for the prosecution of the crime that of his State of origin (perhaps using the residence/domicile criterion) or the one of the State in which the murder has occured?
