This is a silly comment. Ethics are determined 100% by the culture involved. That's why ethics are different from place to place, and from situation to situation. Its not the judges job to access intent based on the ethical standards of what's acceptable on a football field. Court rooms are 100% serious at all times, and what he did lacked tact. Hate to be a square on this one, but he was out of line and he should have known better. I'm not endorsing the excessive punishment though; clearly it exceeds the crime here. He made a mistake, but is being made an example of based on his past reputation and celebrity status, somewhat unfairly.
I have somewhat of a similar story. People who haven't attended court probably lack the perspective necessary to even comprehend this sort of thing. A friend of mine (who now actually has a masters degree) was in somewhat serious legal trouble a few years ago. Wont get into details, but he was looking at less than the time required to be in a prison, but not something to be summarily dismissed. Anyway, knowing the character (or lack there of) of the person testifying, I smirked and kind of chuckled to myself at times with regards to ridiculous testimony. So, then the judge orders the jury out and after they leave, she points in my direction and says to come up to the stand. Naïve as I can be, I didn't realize she was pointing at me. So I go up there and she admonishes me publically--and pretty harshly. I try to explain that I didn't even realize what I was doing, and doubt anyone else could either. She then said she didn't want to hear it and banned me for the day; explaining that Im lucky she didn't put me in jail for a week, for contempt of court. Anyway, its pretty serious business, and even though the punishment was clearly excessive, im not too surprised. Im sure mjw can elaborate.
