His only real options pretrial are a 5k1.1 motion (substantial assistance) in which case the suggested reduced sentence is usually laid out in advance, or plea and pray where you get a slight downward guideline departure for acceptance of responsibility, but that's about it. They don't have many mechanisms to control the application of sentences once they're handed over to the BOP. For example, judges are able to make suggestions on facility placement but the BOP only honors it about half the time. Another example are deficient medical care civil suits where judges have had to actually court-order people out of BOP custody and into private hospitals who had grave medical conditions because you can be gushing blood from every orifice in your body and all the BOP 'nurse' will do is hand you an ibuprofen.

When your ass is handed over to the BOP, your ass belongs to the BOP and much of the work done is by for-profit institutions that earn more by doing less. He's sorely mistaken to think he's only going to do 60 days of a 6 month sentence as a slam-dunk outcome. He might get lucky and get HWH time, he may not.

It is a very common stipulation...many jurisdictions go even further and restrict releasees from even ENTERING an establishment that derives more than 50% of its gross income from the sale of alcohol.

I have even seen jurisdictions that prohibit the introduction of alcohol into the residence where the individual will be living, which can be a real burden on the non-criminal who owns or leases the residence, be it a friend, spouse or partner of the person on misdemeanor or felony supervision.

This. Probation sucks bad, especially if you are person prone to ****ing up and not liking to listen to others. Prison, depending on where it is, is a cakewalk if it is only for a few months. In the old days, probation was a joke, and prison/parole was a lot tougher (in certain ways). Now it is the opposite.

If I were in this spot, I would choose up to 9 months in the joint if the probation length was 2 years or over. I am not going to do multiple calendars in side to avoid 5-7 years of probation, but 9 months is like a hockey season.

probation is like a roach motel. I have known a lot of guys who finished 90% of their probation time, get violated on some ticky tack issue with 2 months to go, and have to do the whole bit inside anyway. Try that on for size.

You can all laugh at fish taco and me if you want. Just remember when Justin gets popped in a gambling raid in LA with 3 weeks left of paper, and the judge makes an example of him by sending him away for the full amount of the probation time, you heard it from us first.

Of course, you ALSO overlook the fact that damned near every federal sentence, to include this one, include a mandatory supervision component post release. In this case, it is two years post-release supervision of which six months will be home confinement with electronic monitoring.

Who is Illya Trincher? Yeah yeah, I know we are supposed to google search these unknown poker players. So I google image searched him and the results returned included a ton of pictures of a poker player that looks around 15 years old and another that looks around 50 years old. They looked like the same person though. Very confused.
