Which one claim exactly is it that has you so concerned about being challenged and do you have an interest in the claim other than that of any other poster/player?

And fwiw, I didn't take the side of USAO at all, although at such times when I think they are right, I do/will.

Gioco is simply saying that the DOJ should have filed motions to strike these claims at some point in the preceding year, the claims lack standing regardless of whether they win, making a discussion about the cases non sequitur to his position.

E.g., whether Kentucky wins or loses their attempt to gain control of those domains would not alter the fact that they have no ownership stake, innocent or otherwise, in the real assets involved in this case, your excellent article suggests that the domain names themselves may already be in some way severed.

Whether Judge Sands would have granted the motions or not would also be non sequitur to whether or not they should have been filed.

Fwiw the DOJ motion to strike the Kentucky claim was very persuasive and imo likely to succeed (no standing bc KY only claims legal ownership but lacks possession of domains, governmental immunity, counter-claim against U.S. improper when not a D). Replies are due on these motions by August 13. It has previously taken the Judge one week to rule on this type of motion.

So ignoring their time to appeal, Kentucky could be ruled out of this thing by mid to late August. If I'm reading this correctly...
