Jesus Christ I wish I had someone like Clamper on my side when I got scammed for 800 dollars on a mmorpg account trade lmfao. I cant even imagine what he could have done with the info I had on the dude. (never did get my money or account back).

Im new here, but this thread caught my eye and I just wanted to say im glad there are people like Clamper in the world. Dude seems to not only be incredibly resourceful and thorough but manages to be impartial until there is very little doubt as to what happened as well.

I will certainly consider not only seeking his help but actually paying him a small fee to help me out if I ever get scammed again.

I am now working hard on the case as a favor to you and will soon be able to explain what IP means. My first clue is that it is very similar to ZIP in zip code. More soon.

Latest pathetic email from Eric Hardt:

"I'm asking you for a reason man. I understand you talking about how its my accounts so its my issue. I absolutely totally agree with that if this happened because passwords were stored on an old computer or someone had seen me type my passwords in. If you would just send me the e-mail from them stating the play was from the same IP address, I'd get the ball rolling and figure out what I can do to make the situation right. However, I want to make sure this isn't a past issue from previous times my identity has been stolen. I don't understand why you're not willing to just forward the e-mail since I'm not getting any contact back from them."

Why is he even bothering with these ******ed responses? This was in response to me saying let's set up a payment plan or I will sue you and put you in jail.

What's there to figure out, dummy? Pay the dude back his money that you stole. What other options could there POSSIBLY be at this point? Do you think anyone believes you didn't just flat out steal $8k?

I'm sure he still pops in here (maybe he's figured out that he shouldn't be logged in) and knows exactly what's been said in this thread. It's odd to say the least that someone who claims to be totally innocent has stopped even trying to defend himself here.

Your choice is pretty easy. Believe he's going to come around on his own/with your persuasion, or just report it.

You probably have no good way of getting reliable information from him no matter what you say at this point, and everything you tell him just helps him build a smokescreen defense.

If you report you were defrauded and he's telling the truth it helps all of you. If he's lying it can only help you because he's never ever going to be anything but a thief if he's lying to you. Thieves don't just up and and change their ways voluntarily. Ever.

This thread is like if a chick catches her boyfriend in the act, knows the obviousness of what she saw, but can't quite pull the trigger on taking the appropriate action because he tells her "it wasn't me."

There's going to be no clean admission of guilt and gamblers who scam like this rarely give such.

First off, why would you post anything that will give Hambone4K any hope that he can get away with this? That seems counter-active to the interests of the 2p2 community, those interests being generally outing and punishing scammers who use this site for such.

Maybe it was some kind of attempt at slowrolling hambone2k, cuz that would be cool. I am not a lawyer but I would presume that any decent lawyer would bring the judge up to speed on the inner-workings of online poker either before the trial if thats allowed or at the beginning.

There are certain obvious other points that I really dont feel comfortable stating here in case you are actually another Eric Hardt account fishing for information, but a judge would easily see right through Erics line of BS here and probably make a QUICK judgement against him, the evidence here when put together is staggering to be honest.

In many states this can be pursued given there is a contract.

No in an average case (no contract, no real names) it cannot. Assets of this nature are not barred by UIGEA (governs U.S. financial institutions. In judicial terms we are "mere players" which has already been carved out) or the wire act (governs game of CHANCE where outcome in the long term is predetermined. I.e. as couts have ruled games without memory). The asset is outlined in an enforceable contract. As long as it was siged, given the evidence he admits functionally stealing it, this is a slam dunk. similar to how that group of players is currently suing Howard Lederer, Chris Ferguson, et al.

It's also in the interests of the 2p2 community to not give the false impression that player to player transfers are anything but risky, and that there is little hope of restitution should somebody decide to screw you over.

Going to civil trial with a competent lawyer over an $8,000 debt is going to be -EV. Lawyers aren't cheap. Small claims court seems to be the best option. And it's probably worth a shot. I was curious though if one person in the history of scams involving player to player transfers had successfully obtained a judgment. If not, then I think that's very telling.

Any restitution case such as this if you win you can get 100% lawyer fees and fees obtained for something like a CPA to audit the numbers from the defendant... There is a contract, chat logs, and posting logs that admit guilt plus data that clearly shows a breach in contract.

I would 110% go to court for the 8k.. In the end you will win 8k plus 3k layer fees. Get bank accounts garnished and really make Eric Hardt (the theif who openly broke a contract and stole money) life's worse then it is today.

Small claims court caps the money amount before the 8k and doesn't allow the laywyer fees to be recouped. I would file a civil case.

Don't forget he has to hire representation that cannot recoup the costs outside of his own pocketbook.
