Also, the right of a company to do business as it sees fit does not remove the right of others to criticise it.
Finally, in many jurisdictions it is quite possible for a court to strike out any clause of a contract that it deems 'unfair' so things are not as clear cut as you make out.
You are, though, quite correct in alluding to the fact that the idea of democracy have nothing to do with running a company.
