If you want to truly get technical then the definition of "penalty" is "a disadvantage or handicap imposed on a player or team." If you register 20 minutes before the tournament begins and start with 10k less chips than other players, you are at a disadvantage. So yeah, I'd say it's a penalty for not registering hours early.
Of course it is. Just because it's not technically a penalty doesn't mean it's not stupid. People see a post where I correct something that isn't factual and misinterpret the meaning behind it as, "he must think it's a good idea". No, it's dumb and it's discouraged me from playing. But I'm not going to say I'm doing it because it's against the TDA, because it's not. I'm not going to play it because it shortchanges my ability to play profitable tournament poker; something accomplished almost as easily by the tournament rake, which is why I don't play many tourneys there to begin with.
But for what it's worth, that's how they get around such things. The disadvantage isn't being IMPOSED on the late players. It's an
effect on the late players as a result of the early players getting more chips. Does it have the same effect? Obviously. Should people who are unhappy about it play in that tournament? Of course not. I don't.
