Hero requests TIME, Hero checks, BB bets $40, Hero folds

Villain is 23/15 with a 6% 3bet over 233 hands. I'm thinking is range for 3betting is super wide wide when he 3bets, so I 4bet for value, as I think worse can call in spots like this. Is this spew? Then I c/f flop. I'm really not sure if I should be doing something different. Flatting pre seems bad, and folding seems to nitty as I think we're way ahead of his range and he could call with KQ, maybe even KJ or AQ (I have seen many villains in spots like this show up with such hands). Thoughts?

4 bet bigger or just call the reraise. Your 4bet has no fold equity. Any pp he is now value betting or trying to take you off a bigger one when you check the flop.
Bet/fold the flop.

This is true except in spots where you have played hands with villain before where he has seen you check top pair. Of course then villain has to be thinking.
