Claim hardship and don't leave. Seriously. She'll have to go through the legal process of eviction (go to court, you'll have to get served, you can appeal, lol and so on) and I've seen illegals squat for 6+ months and not get booted out.

Obv not a permanent solution but it'll buy you some thinking time.

Ya have a reasonable expectation to continue your current agreement based on past conduct & an oral agreement. They have to give ya a month's notice b4 pulling such shenanigans imo (altho my opinion doesn't mean much in NY).

Other than that I think u're pretty funked on this. Y'all could move in with my great aunt...she lives in da bronx imo.

So you wanted to make sure you could get your every penny, but complain when the flexibility is used against you. You are like those whiny complainers who took the ARM loans when mortgage rates were pretty much already at all time lows.

And it is a 22.22% increase, nowhere near 50%.

Finally, here is a clue -- you can't afford to live in the city no matter how much you think you can or want to. Move to the NYC suburbs known as "Jersey", get a train pass, and join the rest of the working poor. Are you somehow special?

Paying 1800 a month in rent is ludicrous.

She has to give you a 30 day notice of rent increase, she has to give you a 30 day notice of moving out EVEN IF you no longer have a current lease. Once the lease expired you went into the "month by month" oral/understood contract and the 30 days notification still applies.

So then once you give the 30 day notice, you still don't leave and she then has to go through the eviction process which usually takes an additional 30-60 days. This is to be done only if you're really desperate.

First, try talking to her, ask for a few months to get things together and get the hell out.

I said "essentially" 50% because of the utilites, I have and am considering Jersey and Long Island. I'm special but, not in the way you suggest.

Yes 1800 a month is ludicrous, how's about 2200?

I'm born and raised in this city and sucks a hafta leave but, look man.. I'm not looking for handouts or a free ride... I just should have gotten a longer grace period or smaller bump.

Its not like we are deliquent tenants, we always pay our rent and are nice people. (My wife cooks for the block, I shovel walkways) etc.

Yup, my lawyer pretty much said this too.

I'm going to try to comprimise.. if we can't, then I'll try to get a few months grace to look around. (its gonna be hard with 3 small children).

I just dont want my electric turned off.

Is the electricity on in your name? If so, then she cannot turn it off or have it turned off.

Is the electricity in her name? If so and she turns it off then you can sue her for slum lord tenant rules, etc etc since the 30 days notice rule is still in effect and even if she starts the eviction process she still cannot legally turn off the electricity due to the slum lord laws.

The electric is in the name of her son.

I have a friend at Con Ed that says I can switch it but, she has access to the basement with the meter and circuit breakers and I don't.

SHe could shut the circuit breakers and the situation could get very messy.

Depending on where you live in NJ, $1800 is not even a little bit ridiculous. I live in a 2 bedrooom 1100 square foot duplex in NJ and I pay $1780 a month. Unless you want to live in Jersey City, or Patterson, you are still going to be paying $1400+ for a decent place that is not tiny.

I had a friend recommend Scotch Plains, Clark and Westfield but, truth be told... I would have babysitting issues in NJ.

I have family in S.I. and L.I. that could help out with the sitting.

That's another major concern.

You can find much better rent in Western Queens and still not be slumming. I dont know where you are right now.

If the legal crap doesnt pan out... search for apartments, houses whatever in Middle VIllage (some parts), Maspeth, Glendale, kew Gardens and Ridgewood. These neighborhoods are not bklyn enough to attract the young hipsters which hike up the rents nor is it Long Island enough to warrant the Long Island rates.

lol, thanks.. I was a season ticket holder for two years back before Wang came along.

I wouldnt mind Queens, although my wife is a special needs teacher and says that Brooklyn and Queens are not good for her and that L.I. is better.

I dunno, we'll see what transpires over the next few days or so.

Having a baby in 3 or 4 weeks is pressing the situation though.

My blood pressure is thru the roof.

First off, I'm not a lawyer. This is not legal advice, etc.

If she unlawfully messes with your electricity, the situation is going to be sticky FOR HER.

As others have said, your tenancy is a periodic one. Any changes in the terms require at least a full period of notice (1 month) before they take effect. So if she gave you notice after April 1, then the new terms don't take effect until June 1. She is responsible for ALL utility payments until June 1 per your prior agreement.

Obviously you have to have electricity. If I were you, what I would do is pay the electric co. if she won't, and document and withold that amount of rent. E.g., $1800 rent - $132.33 in electricity--you pay her $1667.67. Make it clear why you are paying less than the full amount in rent.

I would also try to work something out, e.g., maybe $1900/mo + utils for the next 3 months until you move to a new place. I don't know what rights you have in terms of your pregnant and somewhat incapacitated wife. That's where your lawyer or self-research hopefully comes into play. GL.
