I recently cashed in the WPT at the Commerce Casino, LA, and the cage there would not pay out all my winnings, insisting they had to withhold money for state tax, even though I have an ITIN number, which I got after cashing in WSOP events, and had no trouble in Vegas with them withholding.

I was given two forms - a 592-B (Resident and Nonresident Withholding Tax Statement), and W-2G (Certain Gambling Winnings).

Anyway, I had $3500 withheld so would quite like to get it back - does anyone have any advice in what I have to do?

Sounds like you have to file a CA income tax return. You'll show zero tax liability and the amount that was withheld, and therefore that amount to be refunded. I don't know all the forms you will need to submit, but here is the web site:

Grats on the cash. The two forms that you'll need are Form 540NR and Schedule CA. You can figure them out yourself if you have a lot of spare time this week/year/month/life, or you can bring them to a tax professional. It's possible that TurboTax CA edition can handle your situation, but I'm not certain.
