[Nit]In order to have a "mental state" a being must have a mind.[/Nit] In the wild this refers to the working of a particularly dense and structured nerve cluster called a brain. I can not see this being simulated in-silica in the short term.
Also I think it important to realise that black box logic does not work here. If something acts as if it has a mind, that does not mean it does. A robotic dog could act and behave in the same way as a real dog, but it wont not have a dogs mind or conciseness unless its been specifically programmed with one.
