If one collects the hands histories, one has the copyright for offering that exact pack. If someone else collects such copyrighted packs and repacks them, then he up to has the copyright to that/those new packs. Where the line goes exactly is the matter of the law, but that's basically it. Plus there's one or two more things to think about; the poker site and the players in those hand histories, but as they are performing on a public place, the observer has the rights to those hand histories, except if they are wrongly used, against the other rights of the observed persons or the site itself.
