Absolutely, if the question could arguably lead to an incriminating response (even if the person is not guilty of anything), it is a good way to get out of testifying about a subject the person doesn't want to testify about. Happens at the state level where I work all the time, when people don't want to testify against their buddies, etc.

Edit: That said, that is not what is going on with Flynn.

I mean obviously, you'd point out the guy on the spot if the crime just committed. But, if its something where you drive to the police department and make a statement, you should get a lawyer.
