Ok I need a little advice. If I am involved in a minor fender bender and we exchange information but the police are not called, is either party responsible for paying the damages after both have left the scene of the accident? Thanks in advance.

How do you not know the answer to this? You think the police have to come for someone to be held liable?

i thought it mattered bc there is no proof of exactly what happened, no witnesses so it is essentially my word against theirs. Obv it was my fault but i know they are goin to try and fk me so if i dont settle it how are they going to prosecute me? I was in a rental car that I didnt get the $40 daily insurance coverage on bc I have never been in an accident in my life. There was no damage to the rental and the damage to her truck was minor but I dont really have any $$ to be paying 500-1k for a ****ing fender bender right now

I am not a scumbag but I am broke and cant afford to pay for what might be a small amount of money to some ppl.

I doubt that. You messed up someone's car and are trying to angle shoot so you don't have to pay to have it fixed. What else would that make you?

Your liability coverage should cover the damage to the other vehicle. You shouldn't have to pay a deductible. (500-1k if that's what you were referring to). Call your insurance company and let them sort it out. This is why you pay them a premium.

edit: I used to be an auto claims adjuster

If you have a good credit card and you rented the vehicle with that credit card, you MIGHT have insurance coverage through the credit card.

This came in really handy for me.

Word of advice - don't post stupid questions that you already have answered.
You already are making it clear you don't want to deal with this, so if I was in your shoes, I would do nothing at all.

good plan!! I don't have life insurance because I've never died. Also, like I told the insurance-less whore that hit me "hey if you know you don't have insurance, how about OPENING YOUR EYES AND PAYING FKN ATTENTION!"

Also, good news for you, it's almost surely gonna cost more than 500-1k dollars, repairs for fender-benders can be ridic expensive, b/c they have to replace a whole bumper or panel.

I'm an auto claims adjuster, if you (or anyone else) need input on stuff like this, or auto repair on the cheap, I can hook you up.

Just because the police were never called doesn't mean no one is at fault for the accident. You can make your statement however you want, but the points of impact on the vehicles tell the truth. And, the fact that the vehicle you were driving was a rental means there is no way you can get it fixed and deny involvement (unless you still have the rental and the money to fix it paying cash, which you don't).

Like many people above have stated, you need to call your insurance company rather than letting this go. If you own an automobile and have insurance, your coverages should transfer over to the rental vehicle. If not, and you didn't pay for coverages on the rental car, you're an idiot. At that point, your best bet is to plead ignorance and claim it wasn't explained when you picked the car up.

Funny claim story...Worked a claim one time where a guy messed up a rental car and didn't realize his insurance transferred over. He didn't have the money to pay out of pocket for the repairs as the car was pretty jacked up. So...the idiot stole an identically colored car (same made/model ldo) and swapped all the parts onto the rental.
