Ok so a while back I got a water service that for $20 a month delivers 5 gallon water drums to the house. Everything was good for 2 or so months then I called them and told them I had too much water and don't need any for a month. So the guy said no problem I will cancel this months delivery. The next month they didn't drop off any water, so I called them and he said ya we had your account as invalid your credit card declined. I said this can't be right, gave him my CC number and he charged me the $40 or whatever and I thought all was good. another month goes by and they don't deliver again.....I call and the guy says my CC was declined. I said dude there is no way this card declines....he says well you owe $100 or so dollars...I tell him this is redic and I'm not paying after they have missed deliveries, etc etc.....

So like 6 or so months goes by and now I get a letter in the mail from an attorney. He's saying they are trying to charge me like $1096 or some **** for this lol

I insta go on google and find multiple reviews of this being a shady company

I find the original receipt/contract and I did sign a $20 a month contract for 2 years, and if there is a cancellation it's a $150 charge.

My question is...what do I do? How did they come up with $1000+?

I have to call this lawyer it says but I'd like to know what I should be telling him.

Thanks

You should tell him the truth.

Are you sure that's not what he is charging for the actual water station? I was in a similar situation and once I turned in the actual water dispenser and the 2 drums all was well.

Don't hire a lawyer. Lawyers are expensive and it will probably cost you almost as much as just paying the $1000. Make him to take you to small claims court he probably won't. If you do have to go to court show the judge reviews of how shady they are. Chances are the judge is going to side with the little guy and not some company demanding outrageous money for water.

Was also thinking do you think the high price he is asking is to get me into settling for less?

Hiring a lawyer for a $1,000 claim? It might cost that much for the lawyer so you're on a freeroll for the money. I call the lawyer and tell him to gtfo, see you in court. Tell him you're going to call your States consumer protection agency or the local paper's/TV station's helpline, the BBB, etc, etc, you'll go w/ w/e the judge says after you tell him the BS the company put you through.

Hiring a lawyer for $1000 is stupid. You'll spend more than just paying them.

I'd start by confirming that they didn't get declined by your credit card company. I don't know much about this but if they are super sketchy and using a sketchy payment processor the credit card might have declined them for being suspicious.

Beyond that offer to pay them the $40 you do owe them or $190 if you want to just get this resolved. Pay that with a money order or something that doesn't have any more personal information on it.

A letter costs 50 cents. Lawsuits are much more expensive.

My favorite method of resolving these disputes is accord and satisfaction under the UCC. Basically you send them a letter with check addressing your dispute, what you think you owe and that you are offering a payment in accord and satisfaction of the alleged debt, and make the check for some amount slightly higher than what you think you owe. Make sure that your state adopted this portion of the UCC before doing this.

(above is not legal advice do it at your peril)
