A friend of mine just dropped my brother off at my house after driving home from bars tonight. On the way home he rearended a driver after drinking 6-8 beers, as it turns out however the driver which he rearended was an unlicensed driver. They pulled into a small side street and exchanged infromation without involving police. How should he play this from this point on?

Friend shouldn't pay for any of the damages caused because if the police are involved in the future it can't be proven that your friend was drunk but it can be proven that the other driver was unlicensed at the time.

This, with no pay to prove your friends sobriety at the scene it will fall on the dude who had no license and it will be 100% his fault (If it not already is.)

IANAL but i don't think the fact that a guy is unlicensed necessarily absolves someone of responsibility if they hit him and it was clearly their fault. in this case your buddy will probably get away with it because the cops weren't involved and it was minor, but in a more serious accident i would not count on using this defense

The cops were not involved, but the accident was pretty major, both airbags came out and the truck looked in very bad shape. I would have not thought it to be drivable if I hadn't seen it pull into my driveway. Any sober individual would have got the car towed.

If the uninsured driver asks how your friend will take care of the damages, tell the guy he's gonna consult with an attorney. If that doesn't stop the questions, say that the attorney asked for insurance information, and the guy will get the hint.
