It's been 5 months since I had my final surgery, everything went great and I'm back to my "normal" self.

I had 1 minor scare about 2 weeks ago where my lower abdomen didn't feel right and I was concerned b/c it kind of felt like what started my whole ordeal. Then I remembered I ate some very spicy chicken tikka masala on an empty stomach.

"Yes. Write it down please. Suite XYZ. Buzzer code 123. And we will send you a text to confirm."
"You have my number? It's the same one you just called me on."
"Yes. Okay. See you then! You'll receive our text before your appointment and it'll remind you that you can only cancel 48 hours before without a fee."

Fast forward to an hour ago, Friday night into Saturday morning.

"Excuse me Mr. Zangief? Why are you missing your appointment right now?!"



I HAVE A PHOTOGRAPH OF YOUR TYPED OUT INSTRUCTIONS TO ME VERBATIM. IT SAYS SATURDAY NIGHT INTO SUNDAY MORNING. I FEEL LIKE VENOM IN THE MRI ROOM AGahsdogdhsogh. OH AND YOU NEVER SENT ME A TEXT. WHEN I ASKED YOU ABOUT IT YOU JUST TOLD ME THAT YOU GUYS EMAIL YOUR CONFIRMATIONS.

Oh really?! So what's my email then?! OH that's right you don't have it because you never asked for it because you told me you do TEXT confirmations so I GOT NOTHING. AND NO CALL.

I have verbatim instructions contemporaneously transcribed and photographed with a time stamp. They've admitted to their mistake in not following SOP with the scheduling. I'm getting a call from their head office this morning. If they don't find me a spot I'm going after them with the regulatory board and suing for damages.

A case of mutual confusion.

Let's review the key attributes of 2am on Saturday on the 13th. It's:

- Saturday
- 2am, at night
- on the 13th.

But normal people will associate 2am on Saturday as the nightcap of Friday. So I am sure when they asked "You free Saturday the 13th?" DoctorZangief immediately thought of normal Saturday times. And then the confusion snowballed.

Saturday 2am isn't "Saturday morning" unless you are a trucker or something -- that begins at like 4am at the earliest. When they said "Saturday night into Sunday morning" they were clearly either brainfarting or making the same assumption as DoctorZangief. (Perhaps they didn't look at the calendar again.)

So both are wrong, I guess, although the receptionist is more wrong since it's, like, their job.

If they said 2am on the 13th, you should go at 2am on the 13th. There's no need to get caught up on which day of the week it is.

Duty is questionable. Breach is somewhat likely. You’ve omitted proximate cause, but that probably exists. Damages are nonexistent thus far in your articulation.

More generally, this is in the category of “**** happens” and reminds me of the idiot who sued his dry cleaner for millions of dollars for losing a pair of pants.

I'm glad my co-counsel agrees I have a case here. Damages haven't been realized yet but if my leg goes all Gregory House the greatest harm would be the world losing my naturally cheerful disposition.

But yeah I'm hoping the regulatory talk just gets me one of those secret MRI slots they save for party members.
