I ignore most warnings. That is because my car manual contains several hundred of them, including "warning, your car is dangerous and could run someone over." Most are of similar quality. If I were to set up the liability rules, I would prohibit failure to warn claims for any issue that is open and obvious.

It isn't clear to me where alligators fit on that spectrum. To any native Floridian, they seem obvious. But Disney knows its properties attract patrons that don't know anything about alligators.

I'd take one look at that sign and assume it's a cover-your-ass sign since there aren't lifeguards and they don't want to get sued when some drunk idiot drowns.

Death-by-gator probably wouldn't register, even in Florida in what has to be one of the highest-attended amusement park monstrosities in the world. They don't call it the Happiest Place on Earth because two year olds are getting snack attacked all the time.

Lack of signage is only one of the problems here. Disney exacerbates the danger by peppering the park with performers in anthropomorphic animal costumes which encourages children to approach wildlife as a matter of course.

They were gonna get sued anyway, but if they ignored specific warnings that gators were a problem at that location and didn't do anything about it they're gonna get super sued.

After the tsunami in 2011 there were signs all over the beach in Kauai telling people to stay out of the water. They were not vague and there is no way in hell anybody was unaware. The rough water was full of tourist, including parents with small kids.

In that case blame the parents when a kids gets washed into the rocks. This is different.

I think what they do next will indicate what they could have done previously. More urgent signage. Warnings and disclaimer when checking in. Filling the thing in. The point is no swimming was not enough for most people if they were at all concerned about alligator attacks as a driver. The kid wasn't swimming. The parents were not negligent. People blaming them are either projecting because they don't want to consider that something so random could happen to them so they are pretending they are bulletproof or they are angry asses who look for any opportunity to pile on parents because other people's kids annoy them.

As for me, it would never happen to my family because I would have been sitting in the restaurant letting my kids scream and run around disturbing others while I stared at my phone.

I'm always the first to blame human idiocracy on everything, especially when it comes to wild animal-related tragedies, but blaming the parents here is just really absurd. It's a beach in ****ing Disneyland and there were no sufficient warning signs. I assume none of the movie night staff told them it was not ok for the kid to play in the water. There was NOTHING the parents could have done, common sense didn't fail them, there's just no reason to assume there are alligators in a closed resort that allows for kids to run around unless told so via signs, period. There are infinite cases in history where people do stupid stuff and get killed by wild animals, but this is just a freak accident.

I wouldn't say it's 100% Disney's fault either, but they definitely have enough part in this that I'd sue them for infinite money and expect to win (/settle) pretty much every time.


tldr: freak accident that Disney could/maybe should have prevented, parents did nothing wrong and just got very very unlucky

OT but is this even typical alligator behaviour? Like if you put a kid and an alligator in that spot will it attack every time? I'm asking because I went to the Everglades some years ago and did some eco-tour with a local guide (not one of the tourist bs tours) who seemed really knowledgeable. She basically said that alligators aren't aggressive at all towards humans unless you run into them by accident, or they think you're wounded and thus prey. After the tour we took many pictures where we basically hung out with entirely wild alligators. It would seem a bit tasteless to post them here, but I have one where I'm sitting on the shoreline and there's an alligator in the water maybe 4-5 feet away, and another where I'm sunbathing next to an alligator, both on the ground, he's maybe 30ft away looking at me and not giving two ****s, both gators were bigger than me. So did this happen just because it was a kid and the alligator probably thought it was something else than a human?

(I know the above pic story sounded like I'm some idiot tourist, I'm not one to mess with wild animals but we were just really amazed how these "predators" were just chilling in the sun and didn't care about us at all, I would obv not disturb them and the guide said that taking these types of pics is pretty standard)

Also, mega OT, but I remember the guide saying that the alligators are now endangered at the Everglades because some idiots dumped their pet Burmese pythons at the swamp some years ago, and they took over the ecosystem feeding on the gators. Crazy stuff.

That sign says swimming is allowed but to be careful. A sign that said "Beware! alligators in area. Stay clear of water." would place blame right on the parents.

If there were alligators signs people today would be complaining that the signs weren't big enough or there weren't enough of them or everyone staying there should be given a special alligator safety training or , etc....blah blah blah.

The internet would find some "solution" that would have "solved this problem"

This is just bizarre. 30 years ago an attack happened at Disney at seven seas lagoon. Disney characters visited the kid in the hospital. That might have been worse than the alligator bite.

I thought the Disney officials said this is the first time this has happened?
