ok so i wanna open a website and start selling a good... however its a really good idea and i think will be very succesfull...How do i go about patenting this so other business dont follow me//////

This has got to be the most common question in this forum. The answer is that you can't really protect most ideas. If the idea is that easy to copy, it probably isn't that good an idea for a business. You're going to succeed or fail based on your ability to execute better than competitors. If there's nothing that will give you an edge in executing, then you're probably out of luck.

What is the good idea -- the good or the way of selling it?

If it is the good you might be able to get a patent but if it is just the way of selling it then there is nothing you can do.

Most ideas can be copied, it doesn't make them not good. And execution is important, but luck is a much larger component of success. (e.g. youtube)

If you are doing something creative -- something that can be deemed to be expression -- then copyright would protect your designs although not the actual idea of putting designs on the item.

In all other countries except for the US, the one that files the patent is considered the "owner", in the US it's the one that can prove they invented it first. In your case, it sounds like both are true.

If your idea is truly brilliant perhaps filing a patent is necessary - if, on the other hand, your idea is to put people's faces on the back of their phones, you're going to have a very difficult time preventing others from doing the same.

That doesn't mean it's not a good idea and should't be done; being first to market has advantages in and of itself.
