The California Tribal Business Alliance believes the following principles must be adhered to for any online gaming legislation at the state or federal level. The legislation must:

• Not allow play at Internet cafes.


Why would they be worried about Internet Cafes? Is this to ban Commerce Casino from offering online poker at their live location?

Their reasoning would be that it would stop dedicated poker shops springing up. If you can travel locally to gamble, there's no reason to travel to their facility to gamble.


(Also, their opposition to foreigners is clearly going to run into substantial WTO issues)

The author is so concerned that tribal economies be protected. When it works in the tribes' favor they are all about sovereignty and being able to have self rule and enforce their laws on their land (I support this BTW) but when they are faced with competition they seem to want to revert to being a ward of the state in need of protection from the government.

IMO they can't have it both ways, If they are an independent sovereign body so be it but that means have to deal with "foreign" (state or federally regulated I poker in this case) competition.

I don't believe the USA will allow foreign online poker companies to operate in their regulated market. This 2 year BS may be a smoke screen to keep them at bay for now with the rules to change in 2 years.

If I was a casino owner in California the rules would be ; everyone with a casino/cardroom license would be allowed to offer online poker under a single network. Everyone else would need to pay $2 Million to apply for a license.

Does the above break the WTO rules? In theory it's open to all.

The WTO has been a non factor in gaming for awhile now. The US feels gaming isn't included in the GATS. That is pretty much the end of it.

The US withdrew from the WTO schedule for internet gaming. The penalties and cross applications are still up in the air, along with the rest of the Doha round accords.

The indians deserve no special treatment. They used the feds to circumvent the various state laws that prohibit B&M casinos to build their casino industry.
