Yes, they have a choice, and repeatedly state they consciously are avoiding taking advertising dollars from the major players in the poker world (only or otherwise).

I rest my case. Part of the law is that artists are allowed to rerecord songs by other artists without their explicit permission. That's why there are so many cover bands out there doing U2 or The Rolling Stones or whatever. But if you're going to use the original recording you have to get permission and pay any licensing fees if applicable, even in a parody.

Not a lawyer but I've done some reading on this and this is how I think it works.

Nope. When you distribute a recording of a song somebody else wrote, whether it’s for commercial use (making it for sale) or promotional use (giving it away for free), you are still required to obtain a compulsory license and pay royalties.

If your saying you don't have to ask them to record it that is true but the second you give your buddy a copy or try to sell it your breaking the law.

i would like to think sirius et al did their homework on this before deciding to sell $30 cds and that this is legal for them.

My bad. I misremembered the details of the compulsory license. Still, the point is that they can't say no, you're free to cover any damn song you like as long as you're recording it from scratch and willing to pay the licensing fees.

It's been a while but I remember reading a book about copyright law for artists. I also took a class on law, copyright, and protecting yourself while at the UCLA Film School. Plus, my wife's an Intellectual Property lawyer. Sadly it's in a totally different area so she's not much help there.

I think there was a landmark case involving the Naked Gun movies and Annie Leibowitz believe it or not. They parodied a picture of hers, she tried to sue, she lost because it was a parody and because they didn't actually use her original photo, they recreated it for humorous effect.

So larva as long as you shell out $5 you can listen to the interview oh dont forget that they will have you on recuring billing via Paypal so they can be sure to get your funds as they secret hope you'll forget bout it month after month (yes Im being cynical because thats what subscription sites do they get ya on 'convienent' monthly rebilling so you never miss a moment) and then whoops you forgot th emoney was coming out and now your Overdrawn. Im a big big hater on recurring or auto payments (CLark Howard on CNN/Radio fame has ranted over and over about the evils of them and he has a valid point). Once billers get in your wallet its a bitch to get htem out. I had that exact problem with something this month.. Was supposed to come outta paypal balance and then the backup was my debit card for my bank acct well somebody needs to explain to me why then it went to my share credit card wiht my wife nealy kicking it over the limit when I never chose it as a funding option for that transaction.

Morale of the story: If you can avoid recurring transactions and keep the power of payment within your hands your much better off ya'll

It's actually very easy to stop recurring payments, and dispute the charges if they are made.

On the topic of membership, I feel that the QJ's crew has done alot of hard work for the show and it is fair that they get some kind of payment for it. Ive listened to some other internet podcasts today (2p2 pokercast and donkdown) and I feel that QJ's is way more entertaining

Such a shame IMO. I can't really listen live because I am in Europe, which means listening to the Podcasts.

I liked the shows and thought you guys did a great job, but I am not going to pay for it when there are many other decent podcasts out there to listen to for free.

Must be a tough spot as like you say you need to monetise it somehow, unfortunately for me this wasn;t the answer.

for QJ sake, I hope they haven't sold any copies of the album, it could lead to legal trouble beyond their intentions of selling it.

If they can order a takedown, then selling it would be a serious issue.

+1, i mean, when i sit at the pc and do stuff, its nice to hear something and i liked QJ so far... but its not like, they offer real new news (like a news-site), so cant see my paying for it...

Listen, the music he uses is clearly copyrighted. You can't simply "steal" music, and make a novelty song of it. Furthermore, to do so for any kind of (attempted) financial gain is a no-no without a license from ASCAP.

You can't even play "music on hold" without a license if you want to be 100% legit.

Even if QJ decides that the paywall is a bad idea, they're going to have a helluva time retracting it. It means refunds to the people who paid for it in the first place, which is an even bigger nightmare if it's been more than one month that people have paid subscriptions.

This is so sad. QJ was awesome right after BF, and it was also pretty good when FTP shut down.
