Yes, they have a choice, and repeatedly state they consciously are avoiding taking advertising dollars from the major players in the poker world (only or otherwise).

That's why they have untargeted advertising on their site.

Nope. When you distribute a recording of a song somebody else wrote, whether it’s for commercial use (making it for sale) or promotional use (giving it away for free), you are still required to obtain a compulsory license and pay royalties.

If your saying you don't have to ask them to record it that is true but the second you give your buddy a copy or try to sell it your breaking the law.

My bad. I misremembered the details of the compulsory license. Still, the point is that they can't say no, you're free to cover any damn song you like as long as you're recording it from scratch and willing to pay the licensing fees.

It's been a while but I remember reading a book about copyright law for artists. I also took a class on law, copyright, and protecting yourself while at the UCLA Film School. Plus, my wife's an Intellectual Property lawyer. Sadly it's in a totally different area so she's not much help there.

I think there was a landmark case involving the Naked Gun movies and Annie Leibowitz believe it or not. They parodied a picture of hers, she tried to sue, she lost because it was a parody and because they didn't actually use her original photo, they recreated it for humorous effect.

It's actually very easy to stop recurring payments, and dispute the charges if they are made.

is it just me or is the rebroadcast not working today?

On the topic of membership, I feel that the QJ's crew has done alot of hard work for the show and it is fair that they get some kind of payment for it. Ive listened to some other internet podcasts today (2p2 pokercast and donkdown) and I feel that QJ's is way more entertaining

Such a shame IMO. I can't really listen live because I am in Europe, which means listening to the Podcasts.

I liked the shows and thought you guys did a great job, but I am not going to pay for it when there are many other decent podcasts out there to listen to for free.

Must be a tough spot as like you say you need to monetise it somehow, unfortunately for me this wasn;t the answer.

If they can order a takedown, then selling it would be a serious issue.

+1, i mean, when i sit at the pc and do stuff, its nice to hear something and i liked QJ so far... but its not like, they offer real new news (like a news-site), so cant see my paying for it...

Listen, the music he uses is clearly copyrighted. You can't simply "steal" music, and make a novelty song of it. Furthermore, to do so for any kind of (attempted) financial gain is a no-no without a license from ASCAP.

You can't even play "music on hold" without a license if you want to be 100% legit.

Even if QJ decides that the paywall is a bad idea, they're going to have a helluva time retracting it. It means refunds to the people who paid for it in the first place, which is an even bigger nightmare if it's been more than one month that people have paid subscriptions.
