The Reid-Kyl bill isn't even introduced to Congress yet, let alone up for a vote. The expectation is that it might get attached by Reid to some other piece of must-pass legislation that is put up for a vote during this lame-duck session (which ends Jan. 3rd). The chances of that "might" vary depending on whom you ask.

Cliff's: An industry lobbying group hires a prominent lawyer to give an opinion stating that the proposed law needs to be changed to allow the online poker sites that initially organized and funded the lobbying group to play or else its unconstitutional.

What specifically is unconstitutional about denying companies who broke UIGEA access to the market?

The bill punishes any company or person that offered online poker to US players after Dec. 2006, which is an assumption without trial of guilt to breaking the law. Our constitution guarantees due process, i.e. innocent until proven guilty.

The bill we've seen is just a draft bill. It has yet to be introduced to the Congress. It is thought that Reid will attempt to attach it to other legislation during this lame duck session of Congress (which ends on Jan. 3) as it is unlikely to get any traction during this session as a stand-alone bill.

This is certainly a valid viewpoint.

The counterpoint in this thread is that is applies to anyone that offered it after 2006, but 2 out of the 3 major players after 2006 are owned by the same company/PPA backers and the third (and by far smallest) of the post 2006 guys has seemingly closed shop (AP/UB).

However, I don't really care much about the above since it is certainly a good thing for players to have more options on where to play and what software to choose, especially when you're talking about excluding the best in the world (and best is not even close in this case when talking about PS and now PS + FTP).

At the end of the day, allowing PS to come in at some point or in some form is better for the millions of online poker players that will play under a regulated system, and better for the government and government entities that want the tax money. It's only bad for some of the companies that would compete with Stars or another casino using Stars/FTP software, in the same way that Toyota is bad for Ford.
