Oh, wait, legally? LOL, no. Unless they make it clear somewhere in their T&C's that any particular number may not have a 1/38 chance of hitting, of course they can't. Just like video poker is understood by players to be dealing from a deck of 52 cards, video roulette would be understood to have an equal chance of hitting all 38 numbers, and they would need to disclose if they are doing otherwise.
