Just got a call back from Jennifer at AFMLS and I'm feeling confident now that players will be getting their rakeback payments back.

Jennifer knew all about the remission process and affiliate/rakeback situation and realized that a lot of people are having their rakeback deducted from their balances. She said that they aren't trying to keep rakeback from anyone, but that they didn't know how to differentiate affiliate revenue from rakeback in the data that Full Tilt gave them and they couldn't assume that any affiliate-related payments weren't rakeback.

I asked her how we should go about disputing our balances and she said that players should submit any kind of explanation or proof that some or all of the "affiliate to player transfer" entries in their spreadsheet are rakeback. She said if the details column in the spreadsheet was the name of a known rakeback provider (she even mentioned raketherake and rakebrain by name) that would indicate that it was rakeback and not affiliate revenue. She also said that if you can show a pattern of those entries indicating weekly/monthly rakeback, instead of sporadic fixed bonuses for referring new players for instance, that would be helpful as well. Any other data, like data from your rakeback provider that matches entries in the spreadsheet, could also help. She said that there isn't any fixed format they're looking for in the dispute, and that they're just looking for whatever you can provide that supports the conclusion that your "affiliate to player" entries are rakeback.

Overall I got the feeling that they will handle this situation reasonably and intelligently. If the "affiliate to player payment" rows in your spreadsheet have rakeback providers associated with them and/or follow a pattern of rakeback payments - as mine do - then I would expect you'll get your full balance coming to you (minus whatever actually was affiliate revenue).
Good stuff, thanks for posting

starting to get my dispute files ready, seems pretty simple but I feel like I'm missing something

I had one player signed up under me and I am trying to find what was affiliate payment and what was rakeback

My affiliate payments seem to all be filed under "Transaction" and labeled as "Affiliate to Player"

My Rakeback payments (at least post 2010 - I dont fully understand what was different before that like people say) are filed as "Promotional Payment" and
are labeled as "Player Rakeback Payment"

So basically all of my bonus/edge/rakeback etc seems to be filed under "Promotional Payment" and all of my affiliate payments are filed under "Transaction" and titled "Affiliate to Player Transfer"

So is my situation as simple as that or am I missing something?

Do you have "Affiliate to Player Transfer" transactions that are actually rakeback from your own play? (That's how rakeback was coded until sometime in 2010, apparently). It's up to you to figure this out, and to prove it to the DOJ.

See the link a few posts up that show WillOnTilt's recommended steps.

Just catching up reading, I was tagged as an affiliate and ~31k short which was all affiliate to player transfers. Thanks a lot to Wilt and the PPA for all there help, seems like should be pretty easy to explain in an appeal.

And just to confirm, if your account balance is listed as X, and your disputed claim is rejected, you still get the amount X they said as a minimum amount correct?

I just reread the GCG announcement where they said they will be paying undisputed claims in Feb. It was dated 1/24, a Friday LDO, and it said:

GCG expects to issue payments via ACH before the end of February 2014 and will post further updates on the payment process in 2-3 weeks.

So this Friday is 2 weeks. Most likely we will hear something
Spoiler:
next week

I predicted 1st or 2nd week of February, so I'm sticking with it. By the end of next week, my hope is that at least some of us have received an email with either instructions on how to get our money OR just a heads up that the money will be arriving shortly. After that, I hope at least some people will start getting their funds before March 1st. Because the original petition emails went out in batches, versus all out at once, I think everything else will, too, so I suspect some people may see delays with the email and/or funds - delays in the order of days or a week or two.

Either way, the idea of having my money and this being over definitely brings a smile to my face.

Of course, you can still dispute even if you already submitted the claim. I was just posting information that I believe was being conveyed to me. I'm hoping some good came out of it and it got people fired up to contact the PPA and GCG. I will be disputing my balance.
For anyone that filed already and now wants to dispute their balance. I sent an email with my supporting documentation and they replied the same day to inform me that my petition was updated. Surprising...I know.

Not trolling or complaining I'm genuinely curious what exactly is it that they're even doing with undisputed accounts now? Why is it going to take several more weeks?

If any1 else decides to call Id be interested to know what the payment process will look like.

are they just going to ship or do we need to be looking for other instructions.

would be nice if the PPA had this info. seems like individual players are getting as much or more info than they have given us

They're making arrangements with the DOJ-approved bank, according to their announcement.

Since they are paying $30M (or whatever) to 30,000 (or whatever) different people, I honestly can't blame them for taking a few weeks to make sure everything's set up correctly. Better that then all kinds of F-ups when it's time to send out the money.

with as much money on the line as we have I think little questions like this should be answered by now.

I was one of those that didn't get the very first email. So, I filed a petition and sent my ftp account excel file. Then months ago when the affiliate thing first surfaced, I emailed asking whether I might have been tagged an affiliate by mistake. They never answered my question then but sent me new numbers. So, I filed again including my ftp excel file.

I never got told whether or not I was tagged as an affiliate but I had rakeback through RakeBackPros and for awhile the rakeback was noted as a "affiliate to player transfer". I never got the affiliate email a couple of weeks ago but I was worried that I might have been tagged an affiliate without knowing it. So, I emailed this morning. At first, I got a answer telling what I needed to do to dispute the affiliate tag instead of the answer to the question I asked. I emailed again saying I knew all of that, what I wanted to know was, was I tagged as an affiliate or not. Later this morning I got email saying definitively that I was not tagged by FTP as an affiliate. So, hopefully, I'll be in the undisputed payout group. But, you can be damn sure that I'm keeping that email handy. :-)

Doc

Glad to see the PPA and DOJ are still working together to help sort this out.

While this money is my money, I honestly wrote it off the day it was frozen and never expected to get it back (obv. I hoped I would).

Will def be making a contribution to the PPA once I receive my funds.

You have all these cute digs at the ppa. You a member feeling like your dues aren't well spent or are you just looking for someone to complain about? People aren't living up to your expectations. And? I'm frankly amazed that the PPA and DOJ were able to resolve the affiliate rb stuff so fast. WoT rocked, as well. End of February is a month sooner than we were promised in the last update. I'm thinking ahead of expectations. Not good enough? I guess randomly blame people who are actually helping.
