Here's a response I got from the rep at the KGC when I asked her what the hell is going on with the Blanca liquidation, etc. Nothing really new here except she at least claims that the KGC's lawyers and Blanca's lawyers are in daily contact, so at least it's not "game over" yet, according to her. FWIW, I also sent an email to UB support and got a response in like an hour. It was just some BS copy and paste response that has already been posted in this thread, but apparently there is still at least one live human being left at UB. It's not like this news is encouraging in any regard, but at least people claim that negotiations are going on.

Doesn't AP/UB have until like Jan.2 or 3 to respond to the DOJ? Is this when we can possibly expect to hear something? I tried asking the KGC rep these questions, but she's not too good at answering specific questions. Feel free to bombard the KGC with calls and emails.

Dear xxxxxx,

I apologise, but there is no more information available to us at this time. Everything I write is always in my own words. I assure you the Chairman and legal Counsel of the Commission are in daily contact with Blanca's lawyers. Additionally I participate in regular conference calls with Blanca Management. As soon as there are any meaningful updates they will be published. Feel free to contact us at any time, but please don't expect any more information until the Commission has it.

AP can do whatever they want. No one is going to waste time and money on a civil case vs a company with either no money and no assets or assets and money that are not ****ing traceable

How many extensions will the DOJ give them? I mean eventually they are going to either say pay the fine or jail time right?

This, to be honest they can have all my money, as long as I hear of at least one individual going to prison, and I dont care if they are innocent :P

Having Cereus pay players or not pay is a civil matter, not criminal, therefore jail time is not an option. The DOJ did file criminal charges against a few individuals from UB (Tom, Beckley) and they are the only ones who would theoretically face jail time. That is, of course, if they could ever be found, extradited, and convicted of the charges against them in the US.

I still find it intriguing that UB hasn't simply closed up shop. They may not have the money to pay people, even after the liquidation, but the fact that they appear, or at least claim, to still be working on a solution is surprising. Their site is virtually dead with no traffic and they have no deposits coming in yet they dont go away. I'm certainly not optimistic in any way that we will get paid, but 8 months after Black Friday the fact that UB is still hanging around gives me slight optimism that we may eventually see some of our balances back. However, I still think it is necessary for the DOJ to release frozen funds in order for this to happen. I don't think the liquidation can produce anywhere near the amount of cash needed to pay back players.

Two plus two should start their own poker software created by all of the most trusted 2+2 players.

Right when the site reaches its highest potential, you can try and pull a UB.

So is there any update on when the next "deadline" is for Cereus to get their **** together or come to an agreement or something?
12-16-2011 , 05:30 PM
I believe the new deadline is somewhere around Jan.3rd. Although, I'm not sure what this new deadline specifically calls for.
12-17-2011 , 03:02 AM
Where does this deadline come from? Any link to where that date came from or has someone heard this from the DOJ?

Come on UB, gives us a Christmass present, please...

Just about every time I check there is at least one cash table of .01/.02 or .05/.10 going. And every time I feel like playing I can usually get a table going at .50/1 or 1/2.

So, when tax season rolls around here soon and AP still have not made any kind of official announcement, I am assuming we cannot claim a loss on that money yet? So not only do they steal our money, but if you do your taxes correctly you will have to pay taxes on your stolen money until it is officially announced we aren't getting paid? This just keeps getting better. Please correct me if I am wrong about these assumptions.

*Not an accountant*

If you deposited in 2011 (or maybe even in earlier years) and still had that money equal to your deposit in your account why could you not write it off as an unrecoverable loss? If it is eventually recovered then you declare it as a reversal. Otherwise nobody could ever deduct an unrecoverable loss because there is always some very tiny chance what got stolen could be recovered. I am sure winnings that you never got paid are not going to count as winnings just as you would not pay taxes on an account receivable if you had to write it off due to non payment.

I hope that is true, I don't go see my accountant until March so I was just trying to get a feel what I am looking at for this year.

We definitely do not have constructive receipt of any 2011 winnings on Cereus. In fact, since Cereus was not processing withdrawals in late 2010, if your balance on Cereus on Black Friday exceeded your 2011 winnings on the site, you can amend your 2010 tax return and get money back.

To be honest I do not understand anything on this page except the reply to me

Do you know this as a fact? I know that is an option if Cereus officially announces the money is gone and we will not be repaid, but can we do it before then? The brief conversation I had with my accountant about this earlier this summer made it seem like there had to be some kind of official announcement. Also, Cereus was processing withdrawls just fine in late 2010, there was just an 8k/week limit but I was really backlogged when they first instituted that so I could definitely make an argument I didn't have constructive receipt.
