Some facts:

The borgata has no liability here. The cheaters do.
No one will successfully sue the borgata. There is no "negligence" in the legal sense. There are no reasonable steps that could be taken to stop someone from palming chips from their pocket and adding them to their stack in a room full of hundreds or thousands of people.

For the borgata, its a matter of appeasing the NJ Gaming commission first. Making sure they cooperate, then its all about PR.

Reasonable players understand that this is not borgatas fault, they are the number 1 poker destination on the east coast, by all accounts, everyone praises them and their tournaments, and this happening for the first time in all the years they have been running their tournament series', is a testament to that.

They will do what is reasonable and in favor of the players. It will most likely be something in the middle of: Refund everyone who didnt cash and ICM chop for the rest of the players".

I can see a freeroll scenario as well for all who played in this tournement with additional prize money added by borgata (Probably what they received in entry fees).

Keep in mind, there are 4000 players who arent part of the 27 left. Borgata will want to make those 4000+ players happy before the 27 left. 4000 angry voices are louder than 27 "winners".

Expect a decision by the end of next week. Borgata will make a good PR move and it will be good publicity for them nationwide.

I will give you 100:1 that you cannot make a valid argument that any one of the remaining 27 players had a legitimate shot at winning the tournament - along with the $1,000,000.00 plus first place prize money.

ultimately it falls on Tab. indirectly yes but in the end he is responsible. That being said I still think it is the best poker venue and he does a good job. I hope they identify and prosecute the scumbags.

I've already acknowledged that I was mistaken with respect to the amount of first place prize money. As for your other point, you would lose that bet since one of the 27 was bound to win the tournament - if the state of New Jersey had allowed the tournament to be played out. (You can pay me in Sklansky bucks - whatever they are ...)
