It's more clear that the Final 27 got screwed. But everyone played who played in this mess of a $560 got a raw deal.

Lusardi is obviously the main culprit. But the Borgata is responsible as well for providing the most optimal conditions for smuggling in a rack of fake chips in the history of poker. The fact it happened in this tourney is not a coincidence. Both Lusardi and the Borgata need to be responsible for this.

So enough with the annoying act of piling on Day1ers

Refunding [some] players who did not cash is ridiculous. Once Lusardi has been removed then the remaining player pool as a collective are not effected form an EV standpoint- other than the small +EV of Lusardi's entrance fee (and not including the fact that the tournament was cancelled, of course.) Individuals may or may not have been effected, but the fact that someone came into contact with him during the tournament is not an automatic negative EV situation (as has been assumed by the decision making body.) Ultimately some will, and some will not, have benefitted, but there are many factors influencing one's luck in a tournament and this can be considered just one more in this particular event.

The best solution IMO (other than a goodwill gesture from the Borgata contributing extra of their own money to refund players) would be to refund no one and split the remaining prize pool between the final 27 based on chip counts.

I have no idea if you were affected, I was just curious about your reasoning since you seem pretty determined that you should get a refund.

Is Lusardi still in jail or out on bail?

I'd like to apologise for incorrectly using the word "effected" instead of "affected" in my post above. I'm very anal as a rule, and as such, I feel ashamed.

I suspect he is still in jail. His bail was $300,000 for chipgate and maybe more for the dvd counterfeiting

Won't matter. We are past the point where lucid, polite, well-crafted emails stating our case will make a difference. I felt that once the DGE made their ruling we would find out everything we needed to know about the Borgata's plans for the 27 with the first email they sent us. That first email, just a couple of hours after the ruling, said they were pleased there was a resolution and that we could expect a check within 10 days. Nothing more.
They have had 3 months to consider all possible outcomes and if they thought that we deserved our full equity they would have immediately informed us that they would take care of us. They knew we were expecting to chop the remaining prize pool and that we would be outraged with any resolution which did not do so. The Borgata will be unmoved by our pleading for justice....they have already considered our arguments.
If the final 27 get any more money it will be because of legal action or through the combination of legal action and the presence of a more intense and protracted public outcry than the Borgata anticipated.
