Probably not, but I'm comfortable with the floor exercising his or her discretion there. I don't have much pity if the 4 Bud guy gets his hand killed after saying, "Fold!" but a good floor should consider obvious intent or lack of intent.

The dealer should, but the dealer's inaction should never change what a ruling should be. The dealer provides a service for the players, but the players have no recourse if the dealer fails to provide that service.
RR very well may have the correct conclusion, but it is stemming from an incorrect logic chain. It could very well result in a situation like the one described right above your post.
Trust me, this wasn't a "one-off where the guy made a mistake". This was a regular of the cardroom, whom the other regulars dislike because he pulls this kind of BS. I don't know if he had done this exact move before or not, but he definately didn't make a "mistake". He either did it in hopes of making more money on the hand (a severe angle), or just did it to try to piss people off; he did other things just to piss people off as well.

any one who dose'nt protest has a very nice hand
