Torelli did a video where it just school Doug in Live poker. Doug seems superior in fundamentals but he will have a hard time to compete with the top pros in the live arena.

I used to like Alec Torelli before he had a youtube channel. Now I can't stand the guy.
That video is garbage. Well, maybe not in comparison to his other videos, but pretty bad still. He could have done it in two minutes considering the substance was "I picked up on something. Not sharing what though!"

I thought the vid was good. His opinion on Ivey and edge sorting was spot on. It's a gray area. I think both casinos should pay Ivey but it a little hinky.

I am not taking sides, but does anybody really believe this "freerolling" notion?

Just think it through for a few seconds. It is utterly preposterous that any casino would knowingly lose millions to an edge-sorter in the hope and expectation that they would win the money back in a future and highly uncertain lawsuit. (I imagine that more than one person at the casino lost their job due to these incidents.)

A lot of people have a poor understanding of copyright law on youtube.

What you're doing I would classify as fair use and the way you make your videos and the amount of your own insight into the hand you add gives you a strong defense of fair use.

That said, fair use is an affirmative defense. There is nothing stopping you from receiving threats of lawsuits or even being sued. If you do get sued you can go to court and demonstrate that your usage falls under the doctrine of fair use.

It's kind of like asserting self-defense in a murder case against you. Just because you think you have a very strong case for self defense, and even if the prosecutor things you might, doesn't mean you won't get charged.

Most of the copyright claims that occur on youtube and other sites are automated and I don't know if anyone is particularly targeting you but rather the algorithms got around to you at first by recognizing you have copyrighted content and giving you the option to have the proceeds from ads go to the copyright holder.

I am not a lawyer but I have looked into copyright issues for various reasons over the years. I think if it goes to court it should be fairly easy for any competent lawyer to successfully argue your work falls under fair use. You are not airing entire episodes and you are providing substantial information above what is shown in the clip and the information you provide has value given your status as a winning high stakes player. You're not like one of these yahoos posting videos and just making inane comments or just narrating what they're seeing or those pointless "reaction videos".

Let them sue you. Go to court and assert your work clearly falls under fair use. After that not only will you get to keep the videos up I think you might have an argument for keeping the revenues from your videos. You'll be a youtube hero too. Unfortunately the idiots that type "no copyright infringement intended" in their videos won't understand what the ruling means and continue to make mistakes but it will be good for you and what you do.

You misunderstand. The automated copyright detection you speak of picked up the HSP episodes long ago. GSN has already been collecting revenue from Doug's videos all this time. None of the stuff mentioned in this video happened through YouTube's DMCA system. This was a letter penned by GSN's director of legal affairs, sent via e-mail.

Might be me with a tin foil hat on but would not be surprised at all if Negreanu had something to do with this talking to one of his contacts after he was tweeting about how `illegal' it is to do commentary and talk about strategy over certain shown hands from the past. What a severe lack of understanding what copyright and fair use is.

unfortunately probably not worth fighting if you follow the h3h3 copyright fight he is paying $50k a month to lawyers for some nobody pizza delivery driver to sue him over the last year over him reacting to some of the guys videos with small clips of them being shown.

The funny thing is there are entire episodes of High Stakes Poker you can watch on YouTube right now. Some of them were uploaded several years ago, long before Doug started making videos. Not that it makes them necessarily wrong in regards to suing, but GSN obviously targeted Doug because his channel gets way more views, right?

It can't just be about the views. There are tons of HSP videos with way more views. Some of these have been on YouTube for nearly a decade. There must be some other reason they're singling him out.
