I agree with Bobo. The 16k profit should definitely come into consideration here.
20k makeup to start before second account.
7k extra staked. 16k profit.
The argument could be made the staker outlines what to play, approves everything, etc. This would make the onus 100% on the staker. In this situation, the makeup should be 11k (27k - 16k) or 4k (20k - 16k) if the stakee assumes no responsibility of the initial stake on the second account.
Personally, I think you're both idiots and should just split it down the middle, leaving makeup at 19k (27k - 8k) or 15.5k (23.5k - 8k) if the stakee assumes half the responsibility of the initial stake on the second account.

I'd say in this case the responsibility is on the Staker. All funds in the account are still the Staker's money, and he willingly risked that money by breaking a site's TOS. I don't think the Stakee can take any responsibility here because the money was never his to be responsible for.
Totally stake is $27k minus $23k in the account (which is the backer's money and responsibility) so makeup should be $4k.
