i got into the same problem in Billings, MT. the home game was at a storage and cops busted it. they also took the money but only the money that was from the chips, they didnt take money from our pockets. we all had to go talk to the detectives but they didnt take us to court. i went in, they were about to ask me questions (recording the conversation) and i asked for my lawyer. the cop got sooooooo ***** pissed off at me because he couldnt ask me questions now that i asked for a lawyer.
tbh i dont think you are going to get your money back. we didnt get it. but i read an article that in virginia cops busted a home game at a garage, the players took the cops to court and the players won. they got their money back and everything.
i didnt care for my money because moments before cops got in i lost a big pot so they only took 60 bucks from me lol but i think in total they took more that 3k...
now in this game they didnt take any rake at all. dealers will only take tips and that was it. cops said that it was still illegal because it was a public game. they said that people was inviting other people and anyone could walk in and play, and that made it public. personally i think if we would have take this case to court we could have won but i would have spent more money doing that.
i think there is a poker organization that help people like us that have been busted in home games. i do not know the name but maybe someone here can help out.
