There being little to no oversight turns these into laws without a means to enforce them. So it is essentially legal, as long as nobody shines a light on it too brightly.
It's one thing to be able to profit from selling blood or semen, because those can be regenerated by the body, but there are good ethical reasons selling your own organs isn't legal, because we need them and our bodies will not regenerate them. People in debt, addicted to drugs, etc. would do it, and others might be pressured to do it.
The same ethical reasons don't apply to selling fetuses, because they are not needed and can be regenerated. I guess it's currently not legal because... yuck, but should we be as comfortable with it as selling our blood? Should couples be allowed to finance their summer trips with spring abortions? Why not?
