Parx does not have a magic muck, touching the burn cards is meaningless. If the cards are retrievable, player one could/should have called the floor, he may/would have been ruled the winner of the hand.
It happened quickly. I probably could have explained in better detail, so I'll try now.
The guy stood, then the dealer dealt the river pretty much as the guy threw his hand face down. As the river hit, seat one saw it, processed for about 1-2 seconds, and the dealer touched his cards which were in contact with the burn cards.
The player grabbed the cards from up top and flipped them up, dealer said that they had been mucked and his hand was dead. The floor was not called.
I have always thought that unprotected cards touching burn cards / mucked cards became dead. However my live experience is far from extensive and limited to maybe 10 different venues, so I'm by no means an authority on what would have happened had the floor been called. What I do know is that seat one acted quite foolishly (in that hand and in general) and that since I was not in the hand, it wasn't my place to call the floor.
