Like I said, my case is flimsy at best at this point. But my standard is, "what would Sipowicz do?", and no way Sipowicz lets this guy out of that garage and on his merry way. And when he runs down the case for Lt Fancy, Fancy will back him up as far as he can.
Walt lawyers up as soon as Sipowicz brings him in. Saul says, "Charge him, or release him." Sipowicz has to be restrained from attacking Saul, calls him a Jew bastard, and a fake Jew bastard at that. Saul runs for his life, right to the DA's office. DA sends over Silvia or Cohen. If it's Cohen, he says, "You've got to let him go," and as soon as they do, Walt calls the vacuum guy and disappears forever. If it's Silvia, it's 50-50 which way she plays it. She might play along with, "OK, we'll arraign him in the morning on those charges you mentioned...but you'd better stay up all night tonight putting together a much stronger case than you've got right this minute." Given even that sliver of time, I think Sipowicz or Hank can manage to pull this off.

Walt let the cop in his house, and left evidence out in plain sight. No search warrant needed at that point.
