I know plenty of people who rent out bikes without a business visa. But this is Samui, there are basically no laws.

My point being that what is "legal" is pretty irrelevant in Thailand.

Prostitution and gambling are illegal. Without either of which this thread would not exist.

In terms of things that could get you in serious trouble in Thailand, renting out your spare bike to a friend is right up there with jaywalking.

BTW Ved there was someone linked a few days ago a bunch of links to Condos in the Chaweng area.

No partying for me tonight sorry, I'm not a fan of Chaweng. If you come to Lamai send me a PM and I can show you some places here for rent, but if you are planning on getting degen all the time then Chaweng is definitely the better option.

Hmm, he only rents out to friends that he would trust $2k+ on?
Because what can he do if someone takes advantage of him in one of the many ways possible? He can't call the police right if it's illegal what he's doing?
The contract he makes is just for appearances or maybe he doesn't even write a contract?

Just trying to get a sense for how how much or little of a risk it is to do this without a business visa.. The risk being the motorbike that you could lose or will have to repair yourself/buy new parts etc.

first of all, you can always claim the bike is stolen... so there is that.

I've rented out spare bikes to 2+2'ers before. most people illegally renting bikes out aren't flagging down random tourists coming into town. once you're doing it on a scale that does involve random tourists, you'll legitimize what you're doing or you're taking a lot of risk.

I rent out bikes. And jeeps. In Samui. Not legit yet, but will be eventually. No choice really.

The police generally don't care about immigration matters. There are special immigration police for that.

Having a business visa won't make the police send a crack team of special forces after your missing motorbike. In fact they would laugh in your face if you suggested they do anything other than write down the registration number for insurance purposes.

I don't really have the cash for a business visa but just out of curiosity, how would you protect this business if police won't help you?

What most people do is hold on to the renter's passport until the bike is returned intact. Also illegal, but effective.

You can also take out AAA insurance which covers lots of costs if **** goes down. I know a brit who has over 300 bikes across 3 shops and in reality does not have that many problems, in relation to the amount of bikes, renters and thai staff he uses. Although his wife runs the 3 shops and does all dealing with police etc.. when something does happen.

This is the key. Without the wife you can't even get the insurance.

This is why most people tend to ignore regulations/laws etc. They are very hard to follow if you are not a Thai national. It's fine for bigger businesses because they can afford the legal fees and corporate setup that entails running a company as a foreign national. But most small/hobby size businesses do either by way of a Thai wife/girlfriend having their name on everything, or just ignore the laws entirely.

You can still get the insurance without a wife. If the company is set up correctly. However I just think this type or biz works better if you have a wife involved. You wont get many educated thais working for you, so you need a good thai to keep them inline.
