There is reason to believe that for people like him, molesting kids is a compulsion that societies best hope is curbed by self control. Pornography can be manifested into urges that may cause him to act out upon other children. Fantasy is a predicate in certain types of criminals such as sexual predators and serial killers.

Recidivism rate for child molesters is very high and it leads to a tricky probation. There are a few levels of probation in the case of sexual offenders. The highest is involves violence coupled with rape, then child molesters, and so on based on likelihood of recidivism.

The tricky part is that in some of the higher levels is that the terms of the probation can be so intrusive that it is skirting on unconstitutional. Like searches of their house anytime a kid in the county is reported missing etc. But then again its hard to garner much sympathy when they reoffend at the levels they do.

A friend of mine was on probation for a DUI and a condition was he wasn't allowed to gamble. Now that seems goofy, but keeping a predator from having fantasy materials that may manifest into him reoffending doesn't sound too out of line to me.

Looks like as I said before he high tailed out of town when confronted and didn't stick around to confront this. It left his seat open and Epic gave it Jamie Kaplan. Don't know what the right or wrong answer is here. I can tell you for a fact that DiVita fled quickly when he was confronted by security and Epic

Obviously, this guy should get his 20K back. Beyond that, who knows how much sympathy we should have for this guy, or whether he should still be in jail, when we have almost zero clue what exactly he did. The charges in those documents are way too vague to be of any help. Only a tiny minority of the people on the sex offender list are actually dangerous predators and the rest are on the list, often times for life, for crimes that can be as minor as teenagers having sex with other teenagers, prostitution, or urinating in public. At least it's reassuring that most of this thread is able to look past all the hysteria.

This whole thing is a joke...
The fact that the "Epic (fail) Poker League" is policing members after they have had some success is beyond ridiculous... Either have a hard entry criteria or don't take people's fkn money to begin with Annie... Oh but then there wouldn't be too many people left to play in her little tournament, to pay for the "clean" and "public friendly" champion's prize... A lot of people have skeletons: bankruptcies, misdemeanors, felonies (growing weed is a felony a lot of places), DUI's etc etc... If you screened them all out a lot of people in the poker community simply could not play... And this idiot moron "ethics" stooge speaking on behalf of the EPL is a total joke; he claims that some crimes are worse than others and therefore merit "action", especially if its worse "in the public eye..." (like burning witches at the stake).... THAT'S A LOAD OF ****. Tell some widow who lost her husband and three children to a drunk driver that statutory rape (18 yr old with 16 yr old) is worse than DUI and she if she agrees with you. So then, should Racener be DQ'd because he has 3 of them?!?!?! Of fkn course not.. So where do you draw the line Annie?? What a fkn joke.. These people aren't running for Congress, the guy paid his debt to society amd his entry fee and that should suffice for an open entry tourney... What does Annie want?? All EPL members to be completely and perfectly clean with blonde hair blue eyes and a square jaw so they look and "feel" good to the viewing public??!?!?! Someone else tried this once... Total BS, if you want to produce a shouw, hire actors and don't have a God Damn open entry tourney... God I can't wait till this EPL is nothing more than a "remember that bullzhit?".

His first case is a charge of molestation of a minor (under 18) and sexual battery in 1991, according to the California sex offender listing he was born in 1958 and was 32 years old at the time of the offense.

His second case is a charge of a lewd act with a child 14/15 years of age in 2008, he was 49 years old at the time.

Both cases resulted in convictions.

I don't see what is too vague about these charges to conclude that this guy is a dangerous sexual predator.

Who gives a **** if he is, you can't commit crimes against someone just because they're a criminal and Epic Poker shouldn't have effectively bullied him out of 18.5k because they didn't want him in their club.

They're vague because they could be anything from raping an 8-year-old to consensual sex with a 15-year-old. As creepy as the latter is for a 49-year-old, I'm not sure it makes him a dangerous predator, and it certainly doesn't deserve 20+ years in prison.

I think a 49 year old engaging in a lewd act with a 14/15 year old classifies him as a dangerous predator.
