Hi,

Am considering a move to Amsterdam. From what I'm able to find online, it seems there is no taxation on poker winnings for residents in Holland, so long as the online room or even live trny is in an EU country.

Can anyone confirm or expand on this?

Live poker, yes. Assuming you are tax eligible in the Netherlands of course. All money won in casino's within the EU is taxfree. Some jackpots and lotteries may be the exception to that rule. Read your ToS before playing

Online poker is a lot harder to determine. In june the dutch tax agency published a list of poker sites that, for the time being, are considered taxfree. Before you ask, Pokerstars isn't one of them.

This doesn't apply to sites located outside of the EU and they are therefore tax eligible (you can deduct some of your losses, though).
However, whether some sites are in or out of the EU is highly debated, particular in the case of Pokerstars. Most tax lawyers i've heard about the case seem to be of the opinion Stars should be taxfree also. Please note that several legal cases on this matter are ongoing and this list may change.

Honestly, if you are planning to play a significant volume online, you might want to have a talk with an actual tax lawyer first.

EDIT: You will have to pay 1.2% property taxes on everything you own over 20k euros, which includes poker winnings.

Hi!

I'm looking to move in January to Holland but i don't find 100% confirmed information on how taxation works for pro poker players.

After this (https://www.pokernews.com/news/2015/...alta-23511.htm) it seems that the winnings derived from the online gambling are tax free. Anyone who currently resides on Holland can confirm this?

I live in the Netherlands, play poker online on various sites and don't pay taxes over any of my (albeit meager) winnings.
Disclaimer: I am not a tax expert, Dutch tax legislation on this subject is vague at best, and if you are a pro poker player planning on moving here you should definitely consult a local tax lawyer before doing so.

Anyway, the way i understand it is that, officially, all winnings from online casino's within the EU are tax free. However, there is some discussion about which sites are within the EU. In june, the dutch tax agency released a list of sites they consider within the EU. You can find a copy of that list here: https://nl.pokernews.com/nieuws/2016...unie-24981.htm (in dutch).

For instance Pokerstars.eu isn't on that list and the dutch TA expects you to pay taxes over your winnings there. However you can appeal to this and there is significant precedent (see the link you posted) that those appeals would be succesful.

I am not aware that there are any national taxes, that as so might indicate that there are no EU-taxes either. In Finland the Malta licensed sites like Pokerstars.eu are tax free in spite of the servers possibly being elsewhere.

The pros in Finland seem to file taxes, but I didn't look if they paid taxes. But the general knowledge we have states that there are no taxes. But I think the trick in many countries is that the pros (after two years or whatever) pay taxes.

bc of family im going to move in the next months in the vicinity of netherlands/belgium and if for tax reasons they do not make sense the uk. i very much prefer the netherlands and id like to have some info on that. im a pro and im a eu citizen.
i realize that this information cost money and i dont expect full answers here; unfortunately i do not speak dutch. if anyone could name me some dutch law firms that i could contact or give me some information about taxes id be super happy. just pm me or reply here.

Hi.

I was doing research on poker taxes in the Netherlands and it's basically still a grey area and moving slowly. I got all of my info from here basically, google translated - https://nl.pokernews.com/nieuws/poker-wet/ . "poker and the law" section of dutch poker news. The dude that may help you is this one - http://www.leheux.com/ . I haven't spoken to him but he probably understands the situation better than anyone and I saw a lot of interviews with him. As far as I understand, he has argued in Dutch courts (and successfully) that those taxes on sites that operate within the EU, are contradictory to some EU regulations. So if the sites headquarters are inside EU (I think) you don't pay winnings there. This is a list of sites that are thought to be either inside or outside EU. There is a disagreement between dutch tax authority and poker player representatives, whether pokerstars.eu is inside EU or Not. Tax authorites are arguing they are in Gilbatar, therefore outside EU and u have to pay the 30% monthly tax (I think). Poker representatives argue they've been in Malta since 2012, so any winnings won on pokerstars after 2012 are tax free. This is an overview of which sites are inside the EU and therefore (I think) tax free, and if they're outside the EU, you do pay the taxes on winnings - https://nl.pokernews.com/nieuws/2016...unie-24981.htm

^Yes. If you are tax eligible in the Netherlands, you have to pay 29% tax on all money won in casino's outside of the EU.


3 important things:
- You are responsible for submitting the game-of-chance-tax (kansspelbelasting) form yourself, separate from the standard yearly tax forms. This form is downloadable from here: https://www.belastingdienst.nl/wps/w...ndse_kanspelen
- The form has to be submitted and the taxes paid during the same month that you won the money.
- You are allowed to deduct your buyins, obv.

As far as recent developments, Karedog's post is still mostly accurate, however, dutch poker players and the dutch tax agency will go back to court shortly about which sites are technically within the EU.

Isn't (the) Netherlands getting regulated in June or so? After the EU and other play will depend on laws and sites. And the case that went to court means that there is a tax for poker hidden somewhere?
