Thread has gone off the rails. This is a matter of law.

Did NJ figure out a clever "end run" around PASPA? Or is this latest law a clear violation of PASPA as the leagues maintain.

All this other stuff. UK. Fantasy sports. Existence of illegal sports betting. Irrelevant. This is a matter of law.

NJ is probably going to lose in court. Legalized sports betting is not doomed forever. But PASPA must be repealed in part or whole for this to happen.

People who don't like this decision keep on trying to make a point about this, but it feels like a really weak conflict of interest argument. In any event, NJ really had no shot at this level. They have a slightly better shot at the appeal.

Anyone know what the line is?

Not necessarily as bad as one might think.

Should Governor Christie eventually abandon his quest for the 2016 brass ring and attend to New Jersey's interests in revitalizing gaming, this saga may take a surprising turn:

There was an interesting observation from the Court opinion; let’s see what, if anything, NJ does with it:

"We agree that, had the 2014 Law repealed all prohibitions on sports gambling, we would be hard-pressed, given Christie I, to find an “authorizing by law” in violation of PASPA. But that is not what occurred here."

Repealing all prohibitions basically means anyone could make book. Also, it is hard to see how NJ would enforce an age limit with no prohibitions.

Obviously NJ is not going that route.

I think an age limit of 18 would be enforceable. Gambling bets are just a version of contract, and the law generally holds minors lack capacity to enter into contracts.

The tougher issues would be restrictions as to location and qualifications. Nobody wants a sports book next to a school or church. Nobody wants someone with organized crime connections running the neighborhood sports book. And the accounting / money laundering implications of unregulated gambling are concerning. But not sure how far a state could go in regulating those issues without running afoul of PASPA as interpreted by the Third Circuit.

I don't think NJ would be comfortable in allowing 18 to 20 year olds involved in any kind of gambling. And they couldn't even get into the casino to get to the sports book.

But this is all moot. The time is ripe to repeal PASPA. Whatever sense it made in 1992 no longer applies today. This is the way to go.

All Christie and the rest of the clowns did was to waste the court's time and the tax payer's money.

I don't think repealing PASPA will ever happen in any of our lifetimes. My local congress Frank LoBiondo is for drafting legislation that will allow NJ to have sports betting. Also, I think it would open the door to other states considering sports betting to pass such legislation within a certain time window. Considering the topic of sports betting on Congress's "to-do" list is low priority much less repealing PASPA.

Further complicating matters, Judge Julio Fuentes – who wrote the majority opinion two years ago upholding the ban – this time was the dissenter.

But, holding raffles in sports venues DURING games? Not a problem...

Online sports betting will still violate The Wire Act, I don't see how the elimination of PASPA does anything for the online realm. It opens opportunities for B&M for sure, new revenue streams will open up.

I mean it's pretty obvious not sure how you guys are not seeing the indirect benefits.

States had very little incentive or demand from constituents to legislate online poker by itself. Also, the revenue was too small to justify a framework.

But sports wagering is obviously a game changer in terms of revenue and interest from constituents and it would be logical that states add it on to their online gambling or sports wagering legislation... you know like how three states have done so already, and New York has stated its intention to do so if PASPA was repealed.
