If you are using it to access a provider who is outside the area you are located, and again you're in a state where you can't legally play for real money.. illegal.
However, if you are using a VPN from a country/area where it is legal to play, but you are using it to protect your privacy, check with the site you are playing on for their terms and conditions. They can see vpn usage and can easily lock you out if you aren't able to prove your location or KYC.
It's only illegal if there is a specific law against it.
Almost every law does not make it illegal for a person to play. It's illegal for the people putting the game on.
So, unless its specifically state in a law that the person playing is at risk of a fine or arrest, using a VPN is not illegal.
Obviously being against terms of service is different and not a legal matter.
