Hello, a couple months ago I went on a trip to Florida (I’m from Canada). I was playing poker during a promotional period and won a draw for a $2650 tournament ticket. However, I had to pay a $795 tax.

I did not win anything in the tournament and somehow am now down $795 from winning a draw.

Is there a way to offset so I can get that $795 back? Otherwise, this is total B.S.

Not sure about Canadian tax law, but in the US for a case like this you’d have to claim the $2650 as income, but you could then claim the tourney loss as a $2650 deduction. Gambling losses of any amount up to any claimed income from gambling are deductible in the US. I suspect this may be the case in Canada, but you should probably consult a tax professional knowledgeable in Canadian tax law.

My assumption is this is more of a U.S. tax law matter since this happened in the States, even though I’m Canadian.

File a non-resident return. Ensure that clearly state that no income is associated with . Claim full amount as refund.
