This is being treated as a fraud case by the DoJ. I'm not aware of the DoJ accepting any settlement that forced American victims to relocate abroad to get their money back.
So, DoJ may determine that we're entitled to cash value for the points through remissions, or they may decide we're not, but IMO it's very unlikely availability of points outside the US will play any role in the decision.
