IMO you should go to jail.

The only people that wouldn't notice when they were out of money playing 5k HU matches won't mind paying back the $11k... so you either did it maliciously or you can pay it back.

Either case, stop whining.

taking advantage of some poker sites software fail isn't stealing. Id bet that 98% of people would do the same thing if in op's situation.

He should be made to pay the money back, not one single cent more.

I love the way you found a loophole to freeroll some stuff and thought the best thing to do was make it rly rly rly obvious that you're on to it by playing hundreds of $5k HU sngs against the same person... wp OP !

I bet if you suddenly discovered you could see everyone's cards you'd make it even more obvious than POTRIPPER did

He lost the money Hu to his friend who then went on to lose it to pokerstars regs. They cash out and pokerstars is out $12K. They can't take that money back from those who legitimately won it. It come out of their bottom line read : your rake.

Funny, here I thought 98% of people would realize that Pokerstars wouldn't cash out hundreds of thousands of dollars without having some idea of where the money came from.

1. he was taking advantage of a software fail to steal money. the software fail was an opportunity, and opportunity makes thiefs. i don´t watch my purse, don´t close my room, leave my car open and somebody steals from me, that´s legit then? it was not his money, he knew that, took it anyway, how can this not be stealing?

2. this would actually solve all problems, but seems no option for op. he will find other (obv illegal) ways to play on stars.

As soon as I read your first post I didn't believe you. With a negative $12K account there is no way you wouldn't notice that you were losing more than you had deposited.

And you very soon post that you in fact did know.

You were trying to take advantage of a software glitch to steal money from PokerStars. You just outlined the scam. You partnered with a friend to play $5K HU sng's and both of you would buy-in with phantom money and then Stars would pay the winner with real money. You then collected a free $5K + FPP's each tourney.

Nice try. Now you owe them $12K.

So does Pokerstars have any policies in their ToS about this?
I assume not. Banks have plenty of policies regarding overdrafting. I'm pretty sure PS makes it so you can't overdraft. IMHO, they didn't protect themselves against something like this happening, I understand glitches happen but I don't think it's right for them to claim that the OP has to pay ~12k without anything regarding taking advantage of glitches in the ToS. I know this would never hold up in court obviously as this is completely illegal (lol self-contradiction) but I'm just seeing this from an objective standpoint.

You can't make somebody else pay for your own screw-up is what I'm trying to say without any protection in your own policies regarding this before they even sign up to play.

Morally, I think OP should pay up, and I think that's what is important here but I also think it's wrong for Pokerstars to "force" him to pay for their own glitch.

It's not like the guy hacked into pokerstars and forced false-positive with his account. If a bank ATM malfunctioned and starting spitting out cash into the street, morally the people who pick up the cash should give it back but by no means do I think they're absolutely obligated.

Flame away I guess.
