I think you are correct on both terms sir. Pretty much the only reasons it is still allowed are because it was too small and unimportant for a long time and because governments are slow. Except the Danish government, they quickly forbid everything that looks like fun.
Alos seems pretty misguided to invest large amounts into something that is completely unregulated and has no underlying value, prolly a lot of ppl gonna lose a lot of money there.
